HISTORIC LANDMARK COMMISSION
April 10, 2006

A Regular Meeting of the Historic Landmark Commission was held on April 10, 2006 at
3:30 p.m. with the following members present:

APPROVAL OF THE MINUTES
Commissioner Richardson made a motion to approve the minutes of the January 9, 2006
Regular Meeting. Commissioner Gibson seconded the motion. Motion to approve carried
9:0.
REGULAR MEETING
1) CA-1152: Request for a Certificate of Appropriateness to allow the painting of the
building and the placing of signage in the front windows.
Location: 2406 North
Applicant: Broussard Properties
Mr. Richardson presented the staff report. The applicant, Mr. Broussard, painted
the buildings prior to receiving a Certificate of Appropriateness. In addition, signs
were painted on the windows in the building that houses the beauty shop.

The two buildings are painted mauve. On the windows of the beauty shop, owner
identification signs have been painted. Section 30-21.2 of the Zoning Ordinance
states that attached signs may not be located in or in front of any window or
doorway.
Mr. Richardson recommended approval of the paint color and denial of the painted
signage in the front windows.
Slides of the subject property were shown.
Commissioner Hallmark commented that he has observed cars parked out front to
the curb and blocking the sidewalk.
Vice Chairman Yoes, acting as Chairman, asked for the applicant's comments.
Keith Broussard, the applicant, addressed the Commission and answered questions
from the Commission.
Commissioner Hallmark made a motion to approve a Certificate of Appropriateness
to allow the paint color of the building and to deny the placement of signage in the
front windows at 2406 North as requested in CA-1152. Commissioner Gibson
seconded the motion. Motion to approve carried 8:1 (Petznick).
2) CA-1155: Request for a Certificate of Appropriateness to allow a prefab metal
carport/storage building.
Location: 2501 Hazel
Applicant: Yvonne Sharpton
Mr. Richardson presented the staff report. Mrs. Sharpton, the applicant, originally
had a small building housing a beauty shop where the carport now stands. The
building was destroyed by Hurricane Rita.
Mrs. Sharpton constructed the carport without a building permit or a Certificate of
Appropriateness. Section 30-21.2 of the Zoning Ordinance states that accessory
buildings must be compatible with the scale, shape, roof form, materials, detailing
and color of the main building. The carport does not meet the requirements and is
clearly seen from the street. In addition, the carport extends into the right-of-way
and must be moved, even if approved by the Landmark Commission.
Mr. Richardson recommended denial of the request.

Yvonne Sharpton addressed the Commission and answered questions. Mrs.
Sharpton stated that she had a carport prior to Hurricane Rita.
Discussion followed between the Commission, staff and the applicant.
Vice Chairman Yoes asked for comments in favor or in opposition.
Virginia Jordan addressed the Commission and stated that she had a conversation
with Mrs. Sharpton before the carport was constructed and advised her of
regulations of the district.
Gretchen Hargroder, 2301 Long, addressed the Commission in opposition to the
request.
Patricia Hotalen, 2106 Hazel, addressed the Commission in opposition to the
request.
Les Warren, 1415 Calder, addressed the Commission in opposition to the request.
Dennis Leaseman, 2655 Long, addressed the Commission in opposition to the
request.
Paula Blazek, 2534 Long, addressed the Commission in opposition to the request.
Commissioner Jordan made a motion to deny a Certificate of Appropriateness to
allow a prefab metal carport/storage building at 2501 Hazel as requested in CA-
1155. Commissioner Hallmark seconded the motion. Motion to deny carried 9:0.
3) CA-1157: Request for a Certificate of Appropriateness to allow a prefab metal
carport.
Location: 2093 McFaddin
Applicant: June Weed
Mr. Richardson presented the staff report. The applicant, Ms. Weed, constructed
the carport at 2093 McFaddin without a building permit or a Certificate of
Appropriateness. The carport does not meet the requirements for accessory
buildings and is clearly seen from the street.
Mr. Richardson recommended denial of the request.
Slides of the subject property were shown.

Vice Chairman Yoes asked for comments in favor or in opposition.
Virginia Jordan, 2145 Hazel, addressed the Commission. She verified that there is
a porte cochere at 2093 McFaddin that could be used for parking vehicles.
Commissioner Richardson made a motion to deny a Certificate of Appropriateness
to allow a prefab metal carport at 2093 McFaddin as requested in CA-1157.
Commissioner Brailsford seconded the motion. Motion to deny carried 9:0.
4) CA-1164: Request for a Certificate of Appropriateness to allow the painting of a
house.
Location: 2270 Hazel
Applicant: Conni Rogers
Mr. Richardson presented the staffreport. The applicant, Conn Rogers, painted her
house at 2270 Hazel without a Certificate of Appropriateness. The house is painted
two shades of blue. The house was constructed in the 1990's by BTSD students and
is not listed in the SPARE survey.
Mr. Richardson recommended approval of the request.
Slides of the subject property were shown.
Vice Chairman Yoes asked for the applicant's comments.
The applicant was not present.
Vice Chairman Yoes asked for comments in favor or in opposition.
Virginia Jordan addressed the Commission in opposition to the request. Mrs.
Jordan presented a sample of approved colors for the historic district and a shade
similar to the blue paint on the subject house to show the difference in the colors.
Gretchen Hargroder addressed the Commission in opposition to the request.
Dennis Leaseman addressed the Commission in opposition to the request.
Virginia Jordan addressed the Commission and stated that Marc McDonald was the
realtor that sold the house and he informed the buyers that the horse was located in
an area with restrictions on paint, etc.
Paula Blazek addressed the Commission in opposition to the request.
Commissioner Petznick made a motion to deny a Certificate of Appropriateness to
allow the painting of a house at 2270 Hazel as requested in CA-1164.

Commissioner Richardson seconded the motion. Motion to deny carried 8:0:1
(Yoes).
5) CA-1168: Request for a Certificate of Appropriateness to allow the painting of a
house.
Location: 50 Guffey
Applicant: Bert and Linda Collins
Mr. Richardson presented the staff report. The applicants, Bert and Linda Collins,
currently own the house. The person that they are selling the house to painted the
house two shades of green. The material on the gable is painted a brick color.
Mr. Richardson recommended approval subject to the repainting of the gable.
Slides of the subject property were shown.
Vice -Chairman Yoes asked for the applicant's comments.
Linda Collins, the applicant, addressed the Commission.
Discussion followed between the Commission and staff.
Commissioner Jordan made a motion to table a request for a Certificate of
i Appropriateness to allow the painting of a house at 50 Guffey as requested in CA-
1168 until the May meeting. Commissioner Petznick seconded the motion. Motion
to table carried 9:0.
6) CA-1172: Request for a Certificate of Appropriateness to allow the installation of
a 6' tall wood screening fence in the front yard.
Location: 2560 North
Applicant: Sandra Hammerling
Mr. Richardson presented the staff report. The applicant, Sandra Hammerling,
would like to construct a G tall wood screening fence to buffer the noise generated
by traffic on North Street.
Section 30-21.2 of the Zoning Ordinance allows a solid wall or fence that does not
exceed four feet in height. A fence or wall that is at least 80% open may be erected
to a maximum of six feet.
Mr. Richardson recommended denial of the 6' wood fence and recommended
approval of a fence that is at least 80% open.
(Commissioner Richardson left the meeting.)

Vice -Chairman Yocs asked for the applicant's comments.
Sandra Hammerling, the applicant, addressed the Commission. Ms. Hammerling
presented an alternate to the wood fence. She distributed photos of a wire material
that is 5' high and would be set on 6' high posts.
Discussion between staff, the Commission and the applicant followed.
Vice -Chairman Yoes asked for comments in favor or in opposition.
Virginia Jordan addressed the Commission and asked about the metal carport on the
subject property that is visible from the street.
Mr. Richardson said that he approved the new carport as a replacement to the
existing one destroyed by Hurricane Rita.
Les Warren, 1415 Calder, addressed the Commission. Mr. Warren made the
suggestion that a wood fence be constructed at 4' high in the front of the house and
graduate to 6' on the sides and the back of the house.
Ms. Hammerling withdrew her request for the 6' high wood fence and the metal
fence.

Mr. Richardson said that he could approve a 4' high wood fence.
7) CA-1180: Request for a Certificate of Appropriateness to allow the replacement of
the tile shingles with composite shingles and enlarge a metal carport.
Location: 1900 Broadway
Applicant: Lynda Kay Makin
Mr. Richardson presented the staff report. The applicant, Mrs. Makin, would like
to reroof her office building due to damage from Hurricane Rita. She was using the
tile shingles that she had removed from the carriage house to repair the roof of the
main structure. However, those shingles were destroyed also as a result of
Hurricane Rita.
The new shingles will be architectural style and gray in color. She will reinstall the
existing tiles on the ridge rows.
The existing two space carport was also damaged in the storm. The roof and one
of the poles will have to be replaced. The repairs will include boxing in the poles
to dress up the carport. However, while she is doing this, she would like to expand
the carport to include space for a third car.

Section 30-21.2 states that a lawful nonconforming structure destroyed by an act of
God may be rebuilt as long as there is not an increase in the degree of
nonconformity.
Mr. Richardson recommended approval of the replacement of the tile shingles and
the repairs to the carport with no expansion.
Slides of the subject property were shown.
Mr. Richardson stated that Ms. Makin had a family emergency and would not be
able to attend the meeting.
Vice -Chairman Yoes asked for comments in favor or in opposition.
Patricia Hotalen, 2106 Hazel, addressed the Commission. Ms. Hotalen voiced her
concern regarding salvaging the tile that is to be removed from the house.
Marty Craig, 195 N. 7'' Street, addressed the Commission. Mrs. Craig has a tile
roof on her house and spoke in favor of keeping the tile.
Lawrence Groegor, 875 N. 5"' Street, addressed the Commission in opposition to
replacing the tile roof with composition shingles.
Patricia Hotalen addressed the Commission. She has commissioned a tile
manufacturer in Utah to make molds of the tile roof that is on her house. The
pattern is the same as the roof on Mrs. Makin's house and is therefore available.
Commissioner Broussard made a motion to deny the expansion of the metal carport
and approve the rehab of the carport at 1900 Broadway as requested in CA-1180.
Commissioner Petznick seconded the motion. Motion carried 8:0.
Commissioner Hallmark made a motion to approve the replacement of the the roof
with composite shingles on the house at 1900 Broadway as requested in CA-1180.
Motion failed for lack of a second.
Commissioner Gibson made a motion to table the request for a Certificate of
Appropriateness to allow the replacement of the tile shingles with composite
shingles on the house at 1900 Broadway as requested in CA-1180. Commissioner
Jordan seconded the motion. Motion to table carried 7:1 (Hallmark).
8) 49-HC: Request for a Historic -Cultural Landmark Preservation Designation.
Location: 2106 Hazel
Applicant: Patricia Hotalen

Mr. Richardson presented the staff report. The house at 2106 Hazel was built in
1907 by T.V. Smelker. Mr. Smelker was a partner in several prominent real estate
and insurance companies in Beaumont in the early 1900's. The house was designed
by Henry Conrad Mauer, a prominent architect in Beaumont in the early to mid
1900's.
The house exhibits distinguishable Victorian or Nco-Colonial characteristics and
has not undergone significant structural changes since the 1920's. The house is a
contributing structure to the Oaks Historic District.
Mr. Richardson recommended approval of the request.

Patricia Hotalen, the applicant, addressed the Commission.
Commissioner Jordan made a motion to approve a request for a Historic -Cultural
Landmark Preservation Designation for the house at 2106 Hazel as requested in 49-
HC. Commissioner Brailsford seconded the motion. Motion to approve carried 8:0.
9) Historic Preservation Loan Report
Mr. Richardson stated there is $38,566.85 available in the loan fund.
3) Director's Report
Mr. Richardson told the Commission that next month Dwayne Jones with
Preservation Dallas will be at the May meeting and it will begin at 3 p.m. instead
of 3:30 p.m.
