APPROVAL OF THE MINUTES
Commissioner Craig made a motion to approve the minutes of the Regular Meeting
and Joint Public Hearings held April 16, 2007. Vice -Chairman Makin seconded the
motion. Motion to approve carried 7:0.

REGULAR MEETING
1) Preliminary Plat - River Ranch Subdivision: Consider the Preliminary Plat of River
Ranch Subdivision; 34.33 acre subdivision out of the D. Choate League, Ab. No.
11.
Applicant: Faust Engineering & Surveying, Inc.
Mr. Richardson presented the staff report. The subj ect preliminary plat is an 18 lot,
single family subdivision. The property is on Reins Road in the City's ETJ.
This plat, as originally submitted; was denied by the Planning Commission because
the number of lots served by the single outlet street exceeded the number permitted
by the Subdivision Regulations.
The latest plat of Phase One and the master plan for Phase Two shows that the
number of lots will not exceed the maximum number.
Phase One will be served by a cul-de-sac 1,320 feet in length. Lot sizes will vary
from 0.85 to 1.17 acres. The Subdivision Regulations state that a single outlet cul-
de-sac shall not exceed 800 feet in length. Lots must be a minimum of one acre.
The property owner is requesting a variance to those requirements.
Mr. Richardson recommended approval with a variance to the cul-de-sac length and
minimum lot size. The conditions that were originally listed in the staff report have
been addressed by the engineer.
Chairman Bodwin asked for the applicant's comments.
Richard Faust with Faust Engineering and Surveying,, Inc., the applicant, addressed
the Commission.
Commissioner Leister made a motion to approve the Preliminary Plat of River
Ranch Subdivision subject to variances to the maximum cul-de-sac length and to the
one acre minimum lot size. Commissioner Craig seconded the motion. Motion to
approve carried 7:0. -
2) Prelirninaa Plat - Springwood, Section I: Consider the Preliminary Plat of
Springwood, Section I, Lots 1-5, Block 1; Lots 1-15, Block 2; Lots 1-11, Block 3;
Lots 1-14, Block 4; Lots 1-2, Block 5; a 12.40 acre tract out of the W. B. Dyches
Survey.
Applicant: Faust Engineering & Surveying, Inc.
Mr. Richardson presented the staff report. The subject preliminary plat is a 12.4
acre, 47 lot single family subdivision. The property is located on RFD Road, north
of Highpoint Addition.

Faust Engineering states that all phases will include 102 lots. With the platting of
future phases, the City may require an additional stub -out into adjacent property to
provide another ingress/egress point. In addition, future phases may require the
dedication of additional right-of-way for the DD#6 ditch to the northwest of the
property.
The request was sent to all interested parties. Several conditions were placed upon
the plat as listed in the staff report. Comments were received from the Fire
Department. The street names Rachael and Chase will have be renamed, because
they are duplications.
Mr. Richardson recommended approval subject to the following conditions and
renaming the streets Rachael and Chase:
• A sidewalk along RFD Road will be required. (Planning)
• Show the principal dimensions of the right-of-way and pavement width of
RFD Road. (Engineering)
• Show the radii at proposed street intersections. (Engineering)
• Submit and show drainage calculations for 5-year and 10-year frequency
analysis. (Engineering)
• Show all culvert sizes. (Engineering)
• Show all dimensions on cul-de-sacs. (Engineering)

full right-of-way and utility easements on subject property.. (Engineering)

Commissioner Lois ter made a motion to approve the Preliminary Plat of
Springwood, Section I subject to the following conditions and renaming the streets
Rachel and Chase:

3) Preliminary Plat - Cottage Grove: Consider the Preliminary Plat of Cottage Grove,
Lots 1-19, Block 1; 3.351 acres out of the H. Williams Survey, A-56.
Applicant: Fittz & Shipman, Inc.
Mr. Richardson presented the staff report. The subject preliminary plat is a 3.35
acre, 18 lot single family residential subdivision. The property is located on the east
side of Major Drive, south and west of Gladys West Addition.
Lot sizes will vary from 5,000 sq. ft. to approximately 18,000 sq. ft.
The request was sent to all interested parties. Several conditions were placed upon
the plat as listed in the- staff report.
Mr. Richardson recommended approval subject to the following conditions:
• Provide proof of payment for four street lights and poles. (Transportation)
• Show principle dimensions of Major Drive. (Engineering)
• Show street radii of Cottage Grove Court at intersection with Major Dr.
(Engineering)
• TXDOT must approve access to FM 364. (Engineering)
• Show all legends. (Engineering)
• Submit hydraulic grade line for 100 year frequency. (Engineering)
• Identify survey rods found. (Engineering)
• Show drainage calculations on drainage plan. (Engineering)
• Show size of pipe on drainage plan. (Engineering)
• Show total acreage, street acreage and net acreage on drainage plan.

• Show a 25' rear building setback on the rear of Lots 1-14 or show a note on
the plat that "No accessory buildings of any type shall be permitted to be

Commissioner Craig made a motion to approve the Preliminary PIat - Cottage Grove

4) File 716-OB: Request to abandon a portion of Georgia Avenue from the east right-
of-way line of University Avenue to the west right-of-way line of Cunningham
Street.
Applicant: Gerald McCaig for Lamar University
Mr. Richardson presented the staff report. Gerald McCaig, representing Lamar
University, is requesting that a portion of Georgia Avenue be abandoned. Mr.
McCaig states that with the addition of the new residential facility south of Iowa,
student pedestrian traffic will increase on Georgia.
This item was sent to all interested parties. Water Utilities and Entergy have
facilities in the right-of-way.

Retention of a 60' wide general utility and drainage easement. (Water

No structures or appurtenances shall be placed within the easement. (Water
Utilities)
Water Utilities will not be responsible for any surface restoration when
water main or sanitary sewer main repairs are necessary. (Water Utilities)

Gerald McCaig with Lamar University addressed the Commission.
Commissioner Collins made a motion to approve a request to abandon a portion of
Georgia Avenue from the east right-of-way line of -University Avenue to the west
right-of-way line of Cunningham Street as requested in File 716-OB subject to the
following conditions:

JOINT PUBLIC HEARINGS
Mayor Goodson called the Joint Public Hearings of May 21, 2007 to order and explained
the purpose of the joint hearing process and then turned the meeting over to Chairman
Bodwin. He explained the policies and procedures for the hearing process.
1) File 1881-P: Request for a specific use permit to allow a church in an RCR
(Residential Conservation and Revitalization) District,
Location: 1619 Park
Applicant: New Beginning Christian Center
Mr. Richardson presented the staff report. Pastor Lavelle Lemonier of New
Beginning Christian Center states that church services will be held on Sundays at
10:30 a.m. Other church activities will held during the week. The church sanctuary
will seat approximately 50 persons.

Mr. Richardson recommended approval of the request.
Seventeen notices were mailed to property owners within 200 feet. Two responses
in favor and none in opposition were returned.

comments.
Lavelle Lemonier, Sr. Pastor of New Beginning Christian Center, addressed the
Commission.
Chairman Bodwin asked for comments in favor or in opposition. No comments
were made. The public hearing was closed.
Commissioner Leister made a motion to approve a specific use permit to allow a
church in an RCR District at 1619 Park as requested in File 1881-P. Commissioner
Craig seconded the motion. Motion to approve carried 7:0.
2) File 1882-P: Request for an amended specific use permit to allow the expansion of
a church in an NC (Neighborhood Commercial) District.
Location: 3655. Highland
Applicant: Kingdom Connection Outreach Church
Mr. Richardson presented the staff report. In March, 2005, Pastor Rosetta Jones of
Kingdom Connection Outreach Church received a specific use permit to allow a
church at 3655 Highland. It is now the desire of the church to construct another
2,535 sq. ft. building and additional parking. The building will include a banquet
hall and kitchen.
Mr. Richardson recommended approval subject to the following conditions:
Delete the two parking spaces in the northeast corner of the property
Modify the dumpster space to allow for on -site maneuvering of dump
trucks and a minimum 20' wide driveway
and with a modification to the landscaping/screening requirements along the east
property line (no fencing along the entire length, 8' wide landscape strip along the
north 120' and no landscape. strip along the south 84').
Thirty notices were sent to property owners within 200 feet. No responses in favor
or in opposition were returned.

Applicant: Kingdom Connection Outreach Church
Mr. Richardson presented the staff report. Pastor Rosetta Jones of Kingdom
Connection. Outreach Church is making this request for property located at 145 E.
Alma and 3280 Shannon. The church has purchased a vacant 8,770 sq. ft. building
formerly used as a machine shop. The church would like to use the building as part
of its outreach to the neighborhood by providing a number of social programs, The
current zoning boundary splits the vacant commercial building.
Mr. Richardson recommended approval of the request with a modification to the
land scapingtsereening requirements along the north property line.
30 notices were mailed to property owners within 200 feet. One response in
opposition and none in favor were returned.

4) File 1884-Z: Request for the removal of a lot out of the Oaks Historic District.
Location: 2335 Calder
Applicant: Wayne Ingwersen
Mr. Richardson presented the staffreport. Wayne andKaren Ingwersen own Easy's
Restaurant and the lot in question. In November, 2006, the Historic Landmark
Commission approved a certificate of appropriateness to allow the demolition of a
two story apartment building that was severely damaged during Hurricane Rita.
The Ingwersens intend to expand their restaurant onto the adjacent lot. The subject
property and the building to the west are the only two properties fronting on the
south side of Calder that are in thehistoric district.
On May 14, 2007, the Historic Landmark Commission recommended approval of
the request.
Mr. Richardson recommended approval of the request.
Fourteen notices were mailed to property owners within 200 feet. No responses in
favor or in oppositionn were returned.

Commissioner Craig made a motion to approve a request for the removal of a lot out
of the Oaks Historic District at 2335 Calder as requested in File 1884-Z.
Commissioner Kyles seconded the motion. Motion to approve carried 6:0:1
(Collins).
5) File 1885-Z:Requestfor a zone change from A-R (Agricultural -Residential) District
to RS (Residential Single Family Dwelling) District.
Location: West of Dowlen Road, north of Barrington Heights Addition
Applicant: Leap Engineering, L.L.C.
Mr. Richardson presented the staff report. The zone change request for two tracts
of land are part of the Metropolitan Park development on the west side of Dowlen,
north of Barrington Heights.
The subject property will be developed as a single family residential subdivision.
Mr. Richardson recommended approval of the request.
Eighteen notices were mailed to property owners within 200 feet. One response in
favor and none in opposition were returned.

Bryan Lee, the owner of the subject property, addressed the Commission.

Commissioner Nej ad made a motion to approve a zone change from A-R District
to RS District for property located west of Dowlen Road, north of Barrington
Heights Addition as requested in File 1885-Z., Commissioner Craig seconded the
motion. Motion to approve carried 7:0.
