and called to order at 3:02 p.m. with the following members present:

APPROVAL OF MENUTES
Alternate Commissioner Craig moved to approve the minutes of the Joint Public Hearings held
on June 15, 2020. Commissioner Quraishi seconded the motion. The motion to approve the
minutes carried 5:0.
REGULAR MEETING
1) Preliminary Plat- The Meadows Subdivision, Phase Four - West: Request for Preliminary
Plat approval of The Meadows Subdivision, Phase Four - West, Beaumont, Jefferson County,
Texas.
Applicant: Troy Whitehead, P.E.
Location: 9135-9275 Bellflower Street & 1635-1675 W. Sage
Mr. Boone presented the staff report. Troy Whitehead, P.E. of Schaumburg & Polk, has request-
ed Preliminary Plat approval of The Meadows Subdivision, Phase Four — West. This 13.074
Acre development will extend W. Sage and Meadow Run streets, and consists of 35 residential
lots. All lots meet the requirements for a residential lot. Water and sewer will be provided by an
extension of the city's facilities.
Slides of the preliminary plat were shown.
Staff recommended approval with the following conditions in order to comply with Chapter
26.03, General Resign Principles and Specific Design Standards and Improverrient Require-
ments:
1. Provide an updated Master Plan for "The Meadows" Subdivision.
2. Location(s) of the back slope downspouts must be shown on the construction plans.
3. The 100-yr event analysis must be provided on the construction plans.
4. Correct the north boundary of Block 19. Drawing calls out 150' while the description
calls out 125'.
5. Correct the west boundary of Block 19. Drawing calls out West and the description calls
out East.
6. Show the size of the existing lines.
7. All proposed water lines must be shown on the plans, (provide all information necessary
for the design of water on the plans).
8. Water lines are to be 7' from back of curb and dimensioned as such on the plans.
9. Include the size of the service line to be installed.
10. Possible conflict with fire hydrant and storm sewer at the corner of Bellflower St. and W.
Sage.
11. In -line valve on proposed water line will be needed along Bellflower St,
12. Provide a note stating that the final water main tie-in will be by city forces at the contrac-
tor's expense.
13. Show the size of the existing sewer lines.
14. Show the type of the proposed sanitary sewer lines.
15. Show how the proposed line will tie into the existing main.

16. Include the size of the service line to be installed.
17. Show percent of grade.
18. Show clean -outs and manholes (fiberglass manholes are to be used, unless otherwise ap-
proved by the water utilities engineer).
19. Sanitary sewer lines are to be 7' from back of curb and dimensioned as such on the plans.
20. Must maintain a separation distance between water and sanitary sewer mains in accord-
ance with state and federal regulations. Show the regulations (chapter and article num-
ber) for which the mains were designed on the plan and profile sheets.
21. Show all design calculations for the sanitary sewer mains on the plans with assumptions
as needed.
22. All water and sanitary sewer mains and appurtenances are to be shown on the plans and
installed in accordance with state and federal regulations.
23. Provision of sidewalks.
The following General Notes are needed:
24. 24 hour notice is required prior to any installations or inspections, call 409-785-3001 and
409-785.3019.
25. Contact the City of Beaumont Quality Control Division at 409-785-3004 or 409-785-
3006, regarding any additional water quality and/or sewer discharge requirements.
26. Install a clean out at the property line per City specifications.
27. Plumbing Contractor to make sewer taps and/or install sanitary sewer manholes to City
specifications and be inspected by the Water Utilities Construction Project Manager.
28. City forces will make tap, install valve and/or set water meters at the expense of the con-
tractor.
29. Plumbing Contractor to make final tie-in to water ineter.
The applicant was present. Troy Whitehead, representing Schaumburg and Polk, 8865 College
Street, addressed the commission. He stated that all of the conditions have been addressed and
he will be submitting updated plans.
Alternate Conunissioner Craig moved to approve the request for Preliminary Plat approval of

lowing conditions:

2) Preliminary Plat — Outpost Industrial Park: Request for a Preliminary Plat approval of Out-
post Industrial Park, Jefferson County, Texas.
Applicant: Robert Balfour
Location: 2105-2160 Garrison Way
Mr, Boone presented the staff report. Robert Balfour, of S&R Consulting, has requested Prelim-
inary Plat approval of Outpost Industrial Park. This 14.696 Acre, twelve (12) lot industrial de-
velopment is mostly located in the City of Beaumont's ETJ (Extra Territorial Jurisdiction), how-
ever a portion of Lots 7 & 8 are located in Nederland's ETJ. Water and Sewer will be provided
by Jefferson County Water Control District No. 10.
Mr. Balfour has requested a waiver for the right-of-way width fiom 70' to 60' and the street
pavement width from 40' to 27' due to limited number of lots. The design of the street will meet
County standards.

Slides of the preliminary plat were shown. 1VIr. Boone addressed the waiver requests fi-om the
applicant and mentioned that a discussion had occurred during the workshop before the meeting
concerning the size of the cul-de-sac. Staff recommended approval of the plat with the condition
that the applicant provide adequate right-of-way and pavement dimensions for the proposed cul-
de-sac and that the approval be subject to City and County Engineering requirements.
Discussion followed concerning the size of the pavement and cul-de-sac, especially for commer-
cial vehicles.
The applicant, Robert Balfour, 264 Private Road 635 Dayton TX, addressed the Commission.
He clarified the dimensions of the cul-de-sac, discussed City and County right-of-way require-
ments and stated that he had provided a new preliminary plat with updated dimensions. He stat-
ed that the plat will comply with City and County Engineering requirements.
Brief discussion followed between staff and the Commission regarding the dimensions of the
cul-de-sac and the proposed condition.
Commissioner Quraishi moved to approve the request for a Preliminary Plat approval of Outpost
Industrial Park, Jefferson County, Texas with the following conditions:
1. Must comply with engineering requirements of the City of Beaumont and Jefferson
County.
2. Road shall be designed as per recommended by the geotechnical engineer for the required
load.
Alternate Commissioner Craig seconded the motion. The motion to approve carried 5:0.
JOINT PUBLIC HEARINGS
Mayor Ames called the Joint Public Hearings of July 20, 2020 to order at 3:15 pm and explained
the purpose of the Joint Public Hearing process. Mayor Ames then turned the meeting over to
Chairman Nejad to conduct the Joint Public Hearings.
3) 2416-P: Request an Amended Specific Use Permit to allow the expansion of an au- condi-
tioning supply warehouse in a GC -MD (General Conunercial — Multiple Family Dwelling)
District.
Applicant: M&B Investments, L.L.C.
Location: 980 N Martin Luther King Parkway
Mr. Boone presented the staff report. M.O. Kothawala, representing M & B Investments, L.P.,
is requesting an amended S.U.P. (Specific Use Pen -nit) to allow the expansion of a wholesale
heating and au- conditioning supply business located at 980 N. M.L. King Plcwy. City Council
approved an S.U.P, to allow the existing wholesale heating and air conditioning supply business
in 2007. A Variance for setbacks along the north and east property lines was also approved by
the Board of Adjustment. The new building will provide an additional 5,000 square feet of
space.

The previous Amended SUP was conditioned on a six (6) foot wide landscaping strip along the
west side of the parking area. The additional parking was added, but the landscaping was not. In
addition, staff has become aware of a possible issue with the south property line and therefore
the required parking. This issue could be resolved by adjusting the site plan and if need be the
parking lot, or by purchasing the lot to the south.
Slides of the subject property, site plan and surrounding area were shown. Twenty-four (24) no-
tices were mailed to property owners within two hundred (200) feet of the subject property. No
responses were received in favor or opposition.
Staff reconunended approval of the request with the following conditions:
1. Provide a six (6) foot wide landscape strip along the west side of the parking lot between
the two (2) driveways as per City of Beaumont Ordinance requirements.
2. Provide an eight (8) foot tall, wood or masonry screening fence along the east property
line.
3. Show sidewalk on site plan.
4. Resolve issues with the property line to the south.
Discussion followed concerning the southern property line and the landscaping on the west side
of the property.
The applicant was present. Mahmood O. Kothawala, 980 N. M.L. King Parkway, addressed the
cornmission. He stated that the staff report covered the information and that he understands and
will comply with the conditions.
The public hearing opened and closed without cornrnent.
Alternate Commissioner Craig moved to approve the request for a Specific Use Permit to allow
the expansion of an air conditioning supply warehouse in a GC -MD (General Conunercial —
Multiple Family Dwelling) District, as requested in file 2416-P, with the following conditions:
1. Provide a six (6) foot wide landscape strip along the west side of the parking lot between
the two (2) driveways as per City of Beaumont Ordinance requirements.
2. Provide an eight (8) foot tall, wood or masonry screening fence along the east property
line.
3. Show sidewalk on site plan.
4. Resolve issues with the property line to the south.

4) 2417-P: Request for a Specific Use Permit to allow an RV (Recreational Vehicle) Park in an
Ll (Light Industrial) District.
Applicant: R & P Brothers, L.L.C.
Location: 5497 Famnett Road
Mr. Boone presented the staff report. R & P Brothers, L.L.C., has requested a Specific Use Per-
mit to construct a Recreational Vehicle Resort at 5497 Fannett Road. The proposed RV (Recrea-
tional Vehicle) resort will provide 60 lots. An office/club house will provide laundry facilities,

showers, and men's & women's restrooms. The site plan shows 20 visitor parking spaces and
one ADA compliant parking space.
Slides of the subject property, site plan and surrounding area were shown. Twenty-five (25) no-
tices were rnailed to property owners within two hundred (200) feet of the subject property. No
responses were received in favor or opposition.
Staff recommended approval of this request with the following condition:
1. This project will require an approved drainage plan and will require an adequate deten-
tion basin per Drainage District 46 requirements.
Brief discussion followed concerning the required detention basin and the ADA parking spot.
The applicant was present. Blrupesh M. Patel, 7410 Pebble Beach Drive, addressed the comrnis-
sion. He stated that the staff report covered the information but he wanted to add that the pro-
posed RV resort will provide seven (7) new jobs; three (3) full-time and four (4) part-time.
Discussion followed between the applicant and the Commission regarding the required detention
basin. The applicant stated that the detention will be done under the road. He stated that his ar-
chitect is experienced in new technology that allows underground detention.
The public hearing opened and closed without continent.
Commissioner Noyola moved to approve the request for a Specific Use Permit to allow an RV
(Recreational Vehicle) Park in an LI (Light Industrial) District, as requested in file 2417-P, with
the following conditions:
1. This project will require an approved drainage plan and will require an adequate deten-
tion basin per Drainage District 46 requirements.
Alternate Commissioner Craig seconded the motion. The motion to approve carried 5:0.

STAFF REPORT
Jisan Makanojiya has requested a Specific Use Permit to allow a gaming facility at 4705
Magnolia Avenue. The applicant wishes to have 50 gaming machines at this location. The
hours of operation for the business would be 8 a.m. to 10 p.m. Security will be provided by on
site surveillance. There was no mention of which age groups would be allowed in certain areas
or for what time periods.
It should be noted that gaming facilities that have five or fewer machines tend to be considered
accessory in nature, when part of a primary use, and as such tend to result in fewer negative
impacts on surrounding land uses. However, larger game rooms with dozens of machines take
on the scale of a small casino and as a result, require careful consideration as to their location
and compatibility with surrounding land uses. Some of these considerations include
compatibility with other land uses, noise, traffic as well as safety considerations. As such,
proximity to parks, schools and especially residential uses should be carefully considered in the
review of gaming facilities. This property is immediately adjacent a residential neighborhood
and residential single-family dwellings and is within the vicinity of the Lucas Pre-K Center.
Please note that final occupancy approval is subject to review and acceptance of submitted plans
and field inspections to verify compliance with applicable codes.
Staff recommends denial of the request.

Game Room Processes and Activities
Processess and Activities:
The following staff will be conduction daily tasks throughout
the day.
Sam — Security Personnel will open the building and deactivate
store alarm. In addition the security role will be to mare sure the
patrons as well as staff are safe. Security will be on premise 24
hours/ 7 days a week on duty to ensure the property is well
guarded and patrolled every hour. Security will maintain a log
book noting all observations and incident reports.
8:30 am -- Cleaning personnel will sanitize and vacuum the store
2 times a day,
9:00 pm -- Game room attendant will count their register and
assist customers with change request. Attendant is only required
to give customers change ONLY. Attendants throughout the day
will be required to insure all permits and decals are property
inventoried on a daily bases. Compliance folder should be
readily available upon the request of code enforcement arrival
on premise
10pm- gaming site is closed and doors are locked and all patrons
and staff are to exit the building except Security personnel.
8 CONDITIONS
1. The specific use will be compatible with other properties
around the vicinity. The specific usage will not be injurious
to the use and enjoyment of other properties, nor will it
diminish or impair property values within the immediate
vicinity,
2. The establishment of the specific use will not impeded the
normal and orderly development and improvement of
surrounding vacant properties.
:3. The facility is adequate for utilities, access roads, drainage
and other necessary supporting facilities. All the proper
signage are displayed and will be confirmed upon the
inspection from City of Beaumont Fire Marshall, Electrical,
and. Building Code enforemcent.
4. The design, location and arrangement of all driveways and
parking spaces provided are safe and convenient for
pedestrians and the general public. The driveway is painted
and labeled for proper vehicle movement in and out of the
parking lot.
5, Proper trespassing, lottering, and other applicable signs are
in place to prevent nuisance for odor, fumes, and noise
disturbances.
G. The facility is equipped with high powered LED lighting
for maximum light coverage all around the building. The
lighting will be directional so that it will not disturb or
adversely affect the neighboring properties.
7. Biweekly our facility has landscaping and grasscutting
services to insure harmony and compatibility with adjacent
properties. Our landscaping vendor is Albert Landscaping
