The Planning Manager recommends approval subject to the following
condition and the following variances:
1. A license-to-encroach must be applied for and approved
by City Council prior to recording the replat.
2. Lot 9A:
Minimum lot area - from 5,000 sq. ft. to 4,094.6 sq. ft.
Minimum lot width - from 50' to 39'
Minimum front building setback - from 25' to 20.55'
Minimum side building setback - from 5' to 0.11'
Lot 9B:
Minimum lot area - from 5,000 sq. ft. to 4,268.8 sq. ft.
Minimum lot width - from 50' to 41.6'
Minimum front yard building setback - from 25' to 20.42'
Minimum side yard building setback - from 5' to 3'
Lot 9C:
Minimum lot area - from 5,000 sq. ft. to 3,267 sq. ft.
Minimum lot width - from 50' to 36.5'
Minimum lot depth - from 100' to 90'
Minimum front yard building setback - from 25' to 15.95'
Minimum side yard building setback - from 5' to 0'
Faust Engineering & Surveying, Inc. has applied for a replat
of Lot 9, Block 21. Three houses currently sit on the subject
property. The owner of the property is moving out of state
and would like to sell the houses individually. The house on
Lot 9C extends into the alley by 6.46'. The applicant has
applied for a license-to-encroach.
