6, Cartwright & Roberts Subdivision "A", Beaumont, Jefferson County, Texas.

The Planning staff recommends denial of the request.
Hani Tohme is requesting an abandonment of an alley in conjunction with the development of
the property at 3010 Washington. Due to the shallow depth of the property, an abandonment
request for the alley to the north was submitted. Due to the presence of an 8" sewer line in the
alley, the City of Beaumont Water Utilities department cannot approve the abandonment, and
retention of an easement would not meet their future needs. AT&T states that the alley is used
for telephone service as well. In addition, at this point we have no indication that any adjacent
property owners support the request.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
Being a 0.146 acre tract of land lying in the DAVID BROWN SURVEY,
Abstract No. 5 in Jefferson County, Texas, being out of and a portion of Block
No. 6 of the MAZZOLA ADDITION to the City of Beaumont, Texas, said 0.146
acres being more particularly described as follows:
BEGINNING on the West right-of-way line of FIFTH STREET (a public roadway),
the Southeast corner of a 12.0’ wide Alley on the South half of said Block No. 6 and
being the Southeast corner of the herein described tract;
THENCE West with the South line of the said 12.0’ wide Alley and with the
South line of the herein described tract for a distance of 530.12’ to the Southwest
corner of the herein described tract;
THENCE North, over and across the said 12.0’ wide Alley and with the West line
of the herein described tract for a distance of 12.0’ of the North line of the said 12.0’
wide Alley and being the Northwest corner of the herein described tract;
THENCE East with the North line of the said 12.0’ wide Alley and with the North line
of the herein described tract for a distance of 530.12’ to the West right-of-way line of
the said FIFTH STREET, the Northeast corner of the said 12.0’ wide Alley and being
the Northeast corner of the herein described tract;
THENCE South with the West right-of-way line of the said FIFTH STREET, the
East line of the said 12.0’ wide Alley and with the East line of the herein described
tract for a distance of 12.0’ to the point and place of beginning, containing in
area, 0.146 acres of land, more or less.
