Richardson, Planning Manager SUBJECT: Consider a request for the annexation of 564.83 acres to the City of Beaumont FILE: 745-OB STAFF REPORT The Planning Manager recommends approval. The City of Beaumont is considering the annexation of 564.83 acres of property that lays between Martin Luther King and the Neches River and south of Gulf States Road. The City of Beaumont has agreements with a number of industries located outside the city limits. These agreements require that these industries pay a negotiated amount of money to the City in lieu of being annexed. Until recently, the Equistar/P.D. Glycol facility on Gulf States Road had such an agreement with the City. However, that agreement is now up for renewal and Equistar/P.D. Glycol is balking at renewing the agreement. The proposed annexation begins at the current city limit line near the intersection of Martin Luther King, Jr. Parkway and Florida and then heads in an easterly and northerly direction to the Equistar/P.D.Glycol property. While the width of the annexation varies, State law requires a minimum 1,000 foot wide strip of land to be annexed. Exhibit is attached. PUBLIC NOTIFICATION Notices mailed to property owners . Responses in Favor . Responses in Opposition . LEGAL DESCRIPTION FOR ORDINANCE PURPOSES Being a 564.83 acre tract, more or less, out of parts of the D. Brown - Ab. 5, Beaty, Seale and Forward - Ab. 392, Pierra Lemane - Ab. 163, Jeff and James Chaison - Ab. 435, J. W. Bullock, Ab. 7 Surveys, Jefferson County, Texas, and more particularly described as follows: Beginning at a point on the eastern right-of-way line of the K.C.S. Railroad, same being the city limits line of the City of Beaumont, said point also being the northwest corner of Spindletop Park, a 14.67 acre tract of the J. A. Veatch Survey, Ab. 235222, and the most southerly corner of the K.C.S. Railroad 3.12 acre tract in the J. W. Bullock Survey, Ab. 7; Thence northwest along the city limits line and the west line of the said K.C.S. Railroad tract to the northwest corner of said tract, also being the southwest corner of a 297.37 acre Lamonica Ltd tract in the Jeff and James Chaison Survey, Ab. 435, and the most southerly corner of a K.C.S. Railroad 4.25 acre tract; Thence northwest along the southwest line of the said Lamonica Ltd tract and the northeast line of the said K.C.S. Railroad tract a distance of approximately 665 ft. to a point in the east line of said K.C.S. Railroad tract, said corner also being the most southern corner of a K.C.S. Railroad 1.404 acre >buffer zone @ tract being in the Jeff and James Chaison Survey, Ab. 7; Thence northeast along the most southern line of said K.C.S. Railroad tract a distance of approximately 255 ft to a point in the southwest line of the said Lamonica Ltd tract; Thence northwest along the southwest line of the said Lamonica Ltd tract and the northeast line of the said K.C.S. Railroad tract a distance of approximately 2500 ft to a point in the east line of the K.C.S. Railroad tract, said point also being the northwest corner of the Lamonica Ltd tract and the southwest corner of a 135.47 acre Mobil Oil Corp. tract; Thence continuing northwest approximately 1260 ft to a point in the west line of said Mobil Oil Corp. tract and the east line of the K.C.S. Railroad tract and turning in a northerly direction for approximately 43 ft to a point for corner 10 ft south of the northwest corner of the Mobil Oil Corp. tract; Thence in an easterly direction parallel to and 10 ft south of the north line of the 135.47 acre Mobil Oil Corp. tract for approximately 5155 ft. to a point that is 10 ft. south of the northwest corner of the 135.47 acre Mobil Oil, Jeff and James Chaison Survey, Ab. 435 tract, and a northwest corner of the 146.33 acre Mobil Oil Corp. tract in the Pierra Lemane Survey, Ab. 163 and continuing approximately 2550 ft to a point for corner; Thence in a northerly direction for 2890 ft, more or less, crossing a 656.2 acre Mobil Oil tract, a 4.93 acre Kansas City Railroad tract, and a 54.68 acre Entergy Gulf States tract all in the Beaty-Seale & Forward Survey, Ab. 392, and a 4.13 acre Mobil Oil tract, to a point being the southwest corner of a 0.492 acre Mobil Oil tract and the southeast corner of a 1.033 acre Mobil Oil tract, all three of the D. Brown Survey, Ab. 300005, and continuing north to a point for corner, said point being the northwest corner of the 0.492 acre Mobil Oil tract, the northeast corner of the 1.033 acre Mobil Oil tract, being 150 ft north of the south line of Block 11, D. Brown Survey, Ab. 300005. Thence in a westerly direction 150 ft north of the south line of Block 11, for 1500 ft, more or less, to a point for corner in the west line of Block 11; Thence in a northerly direction along the west line of Blocks 11 & 14 for approximately 1700 ft to a point for corner being the northwest corner of the 27.76 acre Equistar Chemicals tract; Thence in a easterly direction along the north line of the 27.76 acre Equistar Chemicals tract for 1540 ft., more or less to a point being the northeast corner of the said 27.76 acre Equistar Chemicals tract and the northwest corner of a 22.68 acre Equistar Chemicals tract in Block 5, D. Brown Survey, Ab. 300005, continuing approximately 1085 ft. in a southeasterly direction along the most northerly line of the said 22.68 acre Equistar Chemicals tract to a point for corner being the northeast corner of the 22.68 acre Equistar Chemicals tract; Thence in a southerly direction along the east line of said tract to a point and continuing south along the east line of Block 10, D. Brown Survey, Ab. 30005, for a total of 1350 ft, more or less, to a point for corner being 150 ft north of the south line of Block 10; Thence in a southerly direction for approximately 2720 ft., crossing a 0.689 acre Mobil Oil tract and a 2.67 acre Mobil Oil tract in the D. Brown Survey, Ab. 300005, a 54.68 acre Entergy Gulf States tract, a 4.963 K.C. S. Railroad tract and a 656.2 acre Mobil Oil tract all in the Beaty-Seale & Forward Survey, Ab. 392, to a point in the west bank of the Neches River, said point being the southeast corner of the 656.2 acre Mobil Oil tract and the northeast corner of a 146.33 acre Mobil Oil tract in the Pierra Lemane Survey, Ab. 163; Thence following the meanderings of the Neches River in a predominantly southerly direction along the west bank for 1570 ft., more or less, to a point for corner being the southeast corner of said 146.33 acre Mobil Oil tract; Thence in a westerly direction along the south line of the 146.33 acre Mobil Oil tract approximately 3785 ft to a point being the southwest corner of the 146.33 acre Mobil Oil tract in the Pierra Lemane Survey, Ab. 163, and the southeast corner of a 135.47 acre Mobil Oil tract in the Jeff and James Chaison Survey, Ab. 435 and continuing west for 1565 ft, more or less to a point for corner being the northwest corner of tract 2 - Lamonica LTD and the northeast corner of tract 7 - Lamonica LTD, both of the Jeff and James Chaison Survey, Ab. 435; Thence in a southerly direction along the common line of tracts 2 and 7 for approximately 3540 ft., to a point for corner, being in the city limit line, the southwest corner of tract 2, and the southeast corner of tract 7, said point also being in the north line of Spindletop Park, a 14.67 acre tract of the J. A. Veatch Survey, Ab. 235222; Thence in a westerly direction following the city limit line along the most southern line of tract 7 - Lamonica LTD approximately 20 ft to a point for corner being the most eastern corner of a 3.12 acre K.C.S. Railroad tract in the J. W. Bullock Survey, Ab. 7; Thence in a northwesterly direction along the city limit line, the south line of tract 7 - Lamonica LTD and the north line of the 3.12 acre K.C.S. Railroad tract for 945 ft, more or less, to a point for corner being the most northern corner of the 3.12 acre K.C.S. Railroad tract and the most eastern corner of the K.C.S. Railroad 3.12 acre tract in the J. W. Bullock Survey, Ab. 7; Thence in a southwesterly direction along the city limit line and the common line of the K.C.S. Railroad tracts approximately 298 ft to the Place of Beginning, containing 564.83 acres, more or less.
