STAFF REPORT
The Planning Manager recommends approval subject to the following
conditions:
1. Retain an exclusive 20' sanitary sewer easement (Water
Utilities)
2. The easement will need to be prepared, signed and sealed
by a State of Texas Registered Professional Land
Surveyor.(Water Utilities)
3. No structures or appurtenances shall be placed within the
easement property.(Water Utilities)
4. Water Utilities will not be responsible for any surface
restoration if any sanitary sewer main repairs are
necessary.(Water Utilities)
Capital One, N.A., agent for Rosedale Ventures, LP, has applied
for an abandonment of a portion of Chinn Lane that exists between
Major and Walker.
Chinn Lane, east of Walker, is an improved street. In 1981,
the City of Beaumont accepted the right-of-way from the
neighboring property owners for the purpose of extending Chinn
to Major. However, that portion of Chinn, between Major and
Walker was never improved and the City now has no intention
of constructing the street. Because the City is not going to
construct the street, the property owners to either side of
the subject property have requested that this portion of Chinn
be abandoned.
This item was sent to all interested parties. Water Utilities
has two 12" sanitary sewer force mains within the Chinn Lane
right-of-way. They conditioned approval subject to the four
conditions previously listed.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
Being a 1.67 acre portion of Chinn Lane described as follows:
BEGINNING at a bronze pin encased in concrete, said pin being
the intersection of the projected east line of Walker Road with
the projected south line of Chinn Lane as recorded on the plat
of Bel Air Addition located in the W. B. Dyches League, said
plat being recorded in Volume 8, Page 38 of the Map Records,
Jefferson County, Texas;
THENCE South along the east line of Walker Road a distance of
90.51 feet to a point for a corner;
THENCE West a distance of 60.00 feet to a point for a corner,
with said point lying on the west line of Walker Road, and said
point being the PLACE OF BEGINNING;
THENCE N 67 00' 08" W a distance of 21.72 feet to a point for
a corner;
THENCE S 67 00' 08" W a distance of 75.15 feet to a point for
a corner;
THENCE S 63 18' 04" W a distance of 100.00 feet to a point
for a corner;
THENCE S 58 28' 00" W a distance of 505.52 feet to a point
for a corner;
THENCE S 14 36' 00" W a distance of 84.85 feet to a point for
a corner with said point lying on the east line of FM 3120;
THENCE N 30 24' 00" W along the east line of FM 3120 a disnace
of 220.00 feet to a point for a corner;
THENCE S 75 24' 00" E a distance of 84.85 feet to a point for
a corner;
THENCE N 60 44' 00" E a distance of 505.52 feet to a point
for a corner;
THENCE N 63 18' 04" E a distance of 100.00 feet to a point
for a corner;
THENCE N 67 00' 08" E a distance of 100.00 feet to a point
for a corner;
THENCE N 70 42' 11" E a distance of a 39.84 feet to a point
for a corner, said point lying on the west line of Walker Road;
THENCE South along the west line of Walker Road a distance of
100.37 feet to the PLACE OF BEGINNING, City of Beaumont,
