Richardson, Planning Manager SUBJECT: Request for the abandonment of a portion of Trinity Street FILE: 722-OB STAFF REPORT The Planning Manager recommends approval subject to the following conditions: 1. Retain the right-of-way as a general utility and access easement. 2. No structures or appurtenances shall be placed within the easement property. 3. Water Utilities will not be responsible for any surface restoration when water main or sanitary sewer main repairs are necessary. Andy Hatch has requested the abandonment of a portion of Trinity Street that is located between Milam and Franklin. He owns the property on either side of the subject right-of-way. The purpose of the request for abandonment is to allow the use of the right-of-way for the loading and unloading of 18-wheeler trucks at the loading dock on Trinity. Currently, trucks extend into the right-of-way when at the loading dock. Mr. Hatch states that there is very little traffic on this section of Trinity. Abandoning this section of Trinity would allow the use of the loading dock without any traffic conflicts. This item was sent to all interested parties. Water Utilities recommended approval subject to the right-of-way being retained as a general utility easement. Time Warner Cable and Entergy also have facilities in the right-of-way. An easement would satisfy their needs, as well. Exhibits are attached.
