Richardson, Planning Manager SUBJECT: Consider a request for the abandonment of two water line easements FILE: 713-OB STAFF REPORT The Planning Manager recommends approval of this request subject to the following condition:  The abandonment of the existing easements will not be forwarded to City Council for approval until the new water main has been installed, tested and accepted for city maintenance. (Water Utilities) Faust Engineering and Surveying, Inc. is requesting the abandonment of two water line easements located at 6457 Eastex Freeway. These easements need to be abandoned due to the expansion of the Dillard=s store at Parkdale Mall. A new water line easement will be dedicated and a new water line installed to replace those being abandoned. This item was sent to all interested parties. Water Utilities states that the two water line easements cannot be approved until the new water main has been installed, tested and accepted for City Maintenance. This item will not be taken to City Council for approval until Water Utilities has notified the Planning staff that all conditions have been met for the new water main. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCES PURPOSES EASEMENT A A @ That certain 426 sq. ft. tract out of the Fredrick Bigner Survey and being out of a 15.64 acre tract described in Exhibit D of the Third Amendment of Four-Party Operating Agreement as described in Film Code # 101-66-0754 of the Jefferson County Real Property Records; said 426 sq. ft. tract being more particularly described by metes and bounds as follows: LEGAL DESCRIPTION FOR ORDINANCES PURPOSES continued COMMENCING at an A X @ found in concrete in a sidewalk at the southeast Parkdale Mall entrance; said A X @ being North 31 05' 58" West, a distance of 8.96 feet from the northeast corner of building for the existing Dillards store; THENCE North 57 56' 56" East along the north line of the said 15.64 acre tract, a distance of 126.98 feet to a point on the east line of an existing 10 foot water line easement conveyed to the City of Beaumont as shown in Volume 14, Page 245 of the Jefferson County Map Records; THENCE South 32 27' 58" East along the east line of the existing 10 foot water line easement, a distance of 38.41 feet to a point for corner; THENCE South 57 32' 08" West, a distance of 10.00 feet to a point for corner on the said west line of the existing water line easement, and being the POINT OF BEGINNING of the herein described water line easement; THENCE South 32 27' 58" East, a distance of 10.00 feet to a point for corner; THENCE South 57 27' 03" West, a distance of 42.58 feet to a point for corner; THENCE North 32 32' 57" West, a distance of 10.00 feet to a point for corner; THENCE North 57 27' 03" East, a distance of 42.59 feet to the POINT OF BEGINNING, and containing 426 sq ft.
