FILE: 684-OB STAFF REPORT The Planning Manager recommends approval of this request subject to the following condition:  Retain the north 115' as a drainage easement. DD#6 has been in negotiations with Robert C. Mistrot to acquire additional right-of-way needed for the ditch adjoining his property. As part of these negotiations, DD#6 agreed to assist Mr. Mistrot with the abandonment of Guinn Avenue, an unimproved street. Mr. Mistrot owns the property on both sides of the right-of-way. This item was sent to all interested parties. No negative responses have been received. DD#6 approved the request subject to retaining the north 115' of the right-of-way as a drainage easement. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCES PURPOSES Being all of Guinn Avenue, a 60' x 1040.39' public right-of-way dedicated as part of Amelia Heights Third Addition, Volume 5, Page 122, M.R.J.C., City of Beaumont, Jefferson County, Texas, containing 1.43 acres, more or less.
