Richardson, Planning Manager SUBJECT: Consider a request for amendments to the Subdivision Regulations, Sec. 24-15 to regulate when and where sidewalks will be required FILE: 754-OB STAFF REPORT The Planning Manager recommends approval. Sec. 30-35 of the Zoning Ordinance states that no building permit shall be issued, or public utilities extended or connected to a building or structure unless the application for the building permit provides for compliance with the building code, fire code, zoning code, subdivision code and other applicable codes of the City of Beaumont. Sec. 24-15 of the Subdivision Regulations states that sidewalks are only required on all A safe school routes @ and on all arterial and collector streets. The sidewalks shall be installed prior to the issuance of a Certificate of Occupancy and compliance of a lot. Normally, sidewalks are constructed during the development of a subdivision. However, properties subdivided prior to adoption of the Subdivision Regulations on January 22, 1980 were not required to install sidewalks. This leaves many developable properties without sidewalks. The Planning Manager recommends the following: Sec. 24-15. Sidewalks (a) A Certificate of Occupancy and/or compliance for a lot shall not be issued until the sidewalk requirements for that lot are met. When platting, sidewalks shall be installed before the final plat may be filed or a bond or cash payment as allowed by Section 24-26 (a) or (b) may be provided that guarantees the sidewalk will be installed within two (2) years of the final plat. A building permit includes the construction of any sidewalk that may be required for that lot. Sidewalks on at least one side of the public right-of-way with a minimum width of four (4) feet shall be installed by the subdivider along the following routes: (1) On all A safe school routes @. A Safe school routes @ shall be those which have been developed and designated by the Planning and Zoning Commission with necessary assistance from the Transportation Department and appropriate affected school authorities. (2) On all arterial and collector streets. shall be constructed under the following conditions: (1) Residential a. To complete an existing sidewalk system b. Within new subdivisions c. On all arterial and collector streets. d. On all A safe school routes @. A Safe school routes @ shall be those which have been developed and designated by the Planning and Zoning Commission with necessary assistance from the Transportation Division and appropriate affected school authorities. (2) Commercial and Industrial a. To complete an existing sidewalk system b. Within new subdivisions c. On all arterial and collector streets. d. On all A safe school routes @. A Safe school routes @ shall be those which have been developed and designated by the Planning and Zoning Commission with necessary assistance from the Transportation Division and appropriate affected school authorities. (3) The Planning Commission may grant a waiver to the sidew alk requi remen t if the appli cant can prove that there is an engin eerin g reaso n for not insta lling a sidew alk. (b) Where sidewalks are required, the Planning Commission is further authorized to designate and determine, in accordance with the established criteria, whether sidewalks are required on both sides or one side of a given street, and shall insure that its decision with reference to sidewalks is communicated to the appropriate departments of the City.
