STAFF REPORT
The Planning Manager recommends denial.
Gary McCarty, representing Chicken Express, has requested a waiver
of the sidewalk requirement at the location of the new Chicken
Express restaurant being built at 4760 College.
Mr. McCarty states that the construction of the sidewalk would add
additional expense and would not contribute or promote foot traffic
along College. He feels that with the high traffic volume on College, a
sidewalk promoting foot traffic could be hazardous. In addition, he
states that this section of sidewalk would be an isolated section and
not beneficial to any other business along College.
The Subdivision Regulations state that the Planning Commission may
grant a waiver to the sidewalk requirement if the applicant can prove
that there is an engineering reason for not installing a sidewalk.
There is approximately 15 feet between the property line and the
back of curb. The Planning Manager feels that the request is for
financial reasons only and there is no engineering reason for not
installing the sidewalk.
