Richardson, Planning Manager SUBJECT: Consider a request for a waiver of the sidewalk requirement FILE: 794-OB STAFF REPORT The Planning Manager recommends that the site plan be shifted north to allow the construction of a 5' sidewalk. George Newsome, representing Charles Le, has applied for a waiver of the sidewalk requirement along E. Lucas. Mr. Newsome states that from an engineering standpoint, the developer is unable to install a 5' wide sidewalk in the space that now exists. There is 7.5' from the back of curb to the property line. Three feet of that is to be used for the required parking screening. This leaves only 4.5 feet for a sidewalk. In addition, there is an existing utility pole that would fall in the middle of the sidewalk and a storm drain curb inlet at the west end of the property which would be in the sidewalk. Mr. Newsome feels that due to the amount and speed of traffic along E. Lucas, it would be dangerous for pedestrians to walk on a 4.5' wide sidewalk that is up against the curb. Mr. Newsome also states that there are no other sidewalks on the north side of E. Lucas for several blocks in either direction. In September, Mr. Le requested and was approved a zone change and specific use permit to allow for a drive-thru, dumpster and landscaping as part of his convenience store/gas station development. According to the submitted site plan, it appears that the site plan could be shifted approximately 4' to the north and still be able to provide for the 10' wide landscape strip, dumpster and drive-thru. However, in doing so, the new building will not line up with the existing building to the east. Exhibits are attached.
