Richardson, Planning Manager SUBJECT: Consider a request for a sidewalk waiver FILE: 831-OB STAFF REPORT The Planning Manager recommends approval. Tim Andrues, representing Coastwide Leasing, LP, has applied for a waiver to the sidewalk requirement for a new office building being constructed at 8085 Eastex Freeway. Sec. 26.03.004 of the Subdivision Regulations states that the Planning Commission may grant a waiver to the sidewalk requirement if the applicant can prove that there is an engineering reason for not installing a sidewalk. Mr. Andrues states the following reasons for the sidewalk waiver: 1. Due to the elevation of the property, there will need to be additional soil fill brought in to raise the building foundation approximately two (2) feet to provide for adequate drainage. 2. Since the front (east side) of the building will be located at the required setback line, this will leave very minimal spacing between the building and the TXDOT right-of-way which contains additional slope from the open ditch. 3. Based on the recommendations of the applicant=s civil engineer, the resultant slope created from this tight spacing would exceed what would be recommended for the construction of a sidewalk providing safe pedestrian use. 4. There are currently no existing sidewalks located on either side of the subject property. 5. Furthermore, the property located to the south at 8055 Eastex Freeway (Tractor Supply Company) does not have any available space to construct a sidewalk due to the location of its existing parking lot and landscaping.
