FILE: 891-OB STAFF REPORT Garrett Carter, for Hankins Development, has requested abandonment of a 20' x 150' utility easement located at 2290 Gulf Street. Hankins Development plans to construct a retail store at this location, but the easement in question divides the property. An existing sewer line and manhole in the easement would no longer be needed. The south approximately 40' of the easement would remain intact, allowing the applicant to tie-in the sewer discharge from the new structure. This item was sent to all interested parties. The Planning staff recommends approval of the request. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES BEING 0.0691 acre of land, for easement abandonment purposes, part of Lots 1-3 & 16-18, Block 27, McFaddin Heights Addition, recorded in Volume 6, Page 196, Map Records, Jefferson County, Texas; being all of a 10’ wide utility easement along the rear of each of the aforementioned lots; said 0.0691 acre tract being more fully described by metes and bounds as follows, to wit: Note: Bearings, coordinates, distances and acreage are based on the Texas Coordinate System of 1983, South Central Zone, US Survey Feet, and are referenced to SmartNet, North America. COMMENCING at a hole punch in concrete, found on the intersection of the South right-of-way line of Live Oak Avenue and the East right-of-way line of Gulf Street, for the Northwest corner of Block 27; said hole punch in concrete having coordinates of N: 13979894.64, E: 3513676.47; THENCE, North 86 deg. 43 mins. 14 sec. East (Called East), on the South right-of-way line of Live Oak Avenue, a distance of 165.14’ to a point on the intersection of the South right-of-way line of Live Oak Avenue and the West line of a 10’ wide utility easement along the rear of Lot 1, Block 27, for the POINT OF BEGINNING, and Northwest corner of the herein described tract; THENCE, North 86 deg. 43 mins. 14 sec.
