Richardson, Planning Manager SUBJECT: Consider a request for a specific use permit to allow swimming lessons in an RS (Residential Single Family Dwelling) District. FILE: 1756-P STAFF REPORT The Planning Manager recommends approval subject to the following condition: 1. An off-street parking ratio of one space per instructor and one space per four students in any one class shall be provided. (Traffic Manager) and with a modification to the landscaping/screening requirements. Stacey Hansard, the applicant, is requesting a specific use permit to allow swimming lessons at 1265 Sandwood Lane. In July, 2004, the Planning Division cited the Hansards for conducting swimming lessons in their backyard pool. The Planning Division had received numerous complaints about the swimming lessons. Ms. Hansard proposes to conduct water survival instruction during the months of June and July. Lessons will be taught Monday through Thursday, 9:00 a.m. to 5:00 p.m. During a typical session, 8-10 students will be taught. Two instructors will teach the lessons. Exhibits are attached. ANALYSIS CONDITIONS FOR APPROVAL OF SPECIFIC USE PERMIT (SECTION 30-26.E, ZONING ORDINANCE) Application Application is in is not in Comments Compliance Compliance Attached CONDITIONS: 1. That the specific use will be compatible with and not injurious to the use and enjoyment of other property, nor significantly diminish or impair property values within the immediate vicinity; X X 2. That adequate utilities, access roads, drainage and other necessary supporting facilities have been or will be provided; X 4. The design, location and arrangement of all driveways and parking spaces provides for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the general public or adjacent developments; X X 5. That adequate nuisance prevention measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration; X 6. That directional lighting will be provided so as not to disturb or adversely affect neighboring properties; X 7. That there are sufficient landscaping and screening to insure harmony and compatibility with adjacent property; and X X 8. That the proposed use is in accordance with the Comprehensive Plan. X ANALYSIS continued This application is in conformance with seven of the eight conditions necessary for approval. Comments on Conditions 1, 4 and 7 follow: 2. As long as the parking situation does not become an issue, the proposed swimming lessons should not be detrimental to the surrounding neighborhood. 4. The Traffic Manager is requiring that an off-street parking space for each instructor and one space for each four students be provided. At a maximum, four parking spaces would be required. The driveway is approximately 38' long. Four cars could park in the driveway, if stacked. The Traffic Manager also stated that in the event that on-street parking becomes an issue, the City should reserve the right to reconsider the specific use permit approval. 7. A 6' tall wood screening fence surrounds the rear yard. The Zoning Ordinance requires an 8' tall wood screening fence and a 10' wide landscape strip. The applicant is requesting a modification to that requirement. The Planning Manager recommends approval of the modification to the landscaping/screening requirements.
