SUBJECT: Consider a request for a zone change from NC (Neighborhood
Commercial) District to GC-MD (General Commercial-Multiple
Family Dwelling) District or more restrictive district.

STAFF REPORT
The Planning Manager recommends denial of this zone change request.
Jeremiah Brammer, the applicant, is requesting a zone change from
NC (Neighborhood Commercial) District to GC-MD (General
Commercial-Multiple Family Dwelling) District or more restrictive
district for the property located at 2795 Eastex Freeway.
The subject property was originally developed in the 1980's as a
service station. Gasoline sales ceased in the late 1990's. The
property owner states that the property continued to be used for car
repair even after the cessation of gasoline sales. In March, 2001, the
City mistakenly allowed a used car sales business to operate out of this
location. A used car sales business is not a permitted use in an NC
District.
The building on the property is currently vacant. Mr. Brammer
would again like to use the property for a used car sales lot and
mechanic shop. An auto mechanic shop is permitted in a NC District
with a specific use permit. Mr. Brammer=s request for a zone change
to GC-MD would allow both uses by right.
The Comprehensive Plan designates this area as an A Activity Corridor @.
An Activity Corridor may include highway commercial and open
display retailing, wholesale distributing and warehousing operations,
restricted light industry, business offices, hotels and motels and higher
density residential development.
In reviewing the existing zoning pattern, it appears that the subject
property, some freeway frontage north of Delaware and the strip
commercial to the south of the subject property was zoned NC to
protect the RM-H zoning to the west and the RS zoning on the north
side of Delaware.
