SUBJECT: Consider a request for a specific use permit to allow a public
charter school in a CBD (Central Business District).

STAFF REPORT
The Planning Manager recommends approval subject to the school
getting permission to use parking in a nearby parking lot or obtaining
a special exception to the parking requirement from the Zoning
Board of Adjustment.
Eagle Academy of Beaumont is requesting a specific use permit to
allow a public charter school in an existing building at 405 Magnolia.
The school will serve approximately 150 middle and high school
students. The students will attend school in 4 1/4 hour sessions
beginning at 8 a.m. and ending at 5 p.m. Hours of operation will be
7 a.m. - 6 p.m. The maximum number of students on campus at
one time will be 100. Students will be served by eight to twelve
faculty members and staff.

ANALYSIS continued
This application is in conformance with seven of the eight conditions
necessary for approval. Comments on Conditions 1, 4 and 7 follow:
1. The proposed charter school will be compatible with
surrounding uses.
4. Only nine of the required thirty-seven parking spaces can
be accommodated on the subject property. The other
existing parking spaces do not meet current parking
standards. The school is asking First Baptist Church if
they can use some of their parking spaces. First Baptist
has a parking lot across Magnolia. If the school is unable
to obtain additional parking within 400 feet of the
facility, it must receive approval of a special exception
to the parking requirement by the Zoning Board of
Adjustment.
7. The building and parking lots are all existing and were
constructed prior to current landscaping requirements and
are therefore A grandfathered @.
