Richardson, Planning Manager SUBJECT: Consider a request for a specific use permit to allow a church in an RS (Residential Single Family Dwelling) District. FILE: 1818-P STAFF REPORT The Planning Manager recommends approval of this request. Spindletop Unitarian Church is requesting a specific use permit to allow a church in an RS (Residential Single Family Dwelling) District. The property is located at 125 E. Caldwood. On the 1.37 acres of property sits a 3,643 sq. ft. house. Spindletop Unitarian Church has been located at 1575 Spindletop Road since 1966. It is the church=s desire to relocate to the subject property. The pastor states that they chose this location because they feel that it is an ideal fit in that it is at the threshold of the neighborhood and is in close proximity to both Caldwood Elementary and First Christian Church. The current plan calls for providing 50 seats for congregants with a proposed expansion to 100 seats at sometime in the future. Services will be held on Sunday mornings and there will be small groups of about 10 people meeting at the church during certain evenings after 6 p.m. A 5' x 6' monument will be constructed to identify the church. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES Being the North 105' of Lot 52 and Lot 53, Block 4, Caldwood Addition, City of Beaumont, Jefferson County, Texas, containing 1.39 acres, more or less. ANALYSIS CONDITIONS FOR APPROVAL OF SPECIFIC USE PERMIT (SECTION 30-26.E, ZONING ORDINANCE) Application Application is in is not in Comments Compliance Compliance Attached CONDITIONS: 1. That the specific use will be compatible with and not injurious to the use and enjoyment of other property, nor significantly diminish or impair property values within the immediate vicinity; X X 2. That the establishment of the specific use will not impede the normal and orderly development and improvement of surrounding vacant property; X 3. That adequate utilities, access roads, drainage and other necessary supporting facilities have been or will be provided; X 4. The design, location and arrangement of all driveways and parking spaces provides for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the general public or adjacent developments; X X 5. That adequate nuisance prevention measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration; X 6. That directional lighting will be provided so as not to disturb or adversely affect neighboring properties; X X 7. That there are sufficient landscaping and screening to insure harmony and compatibility with adjacent property; and X X 8. That the proposed use is in accordance with the Comprehensive Plan. X ANALYSIS continued This application is in conformance with all eight conditions necessary for approval. Comments on Conditions 1, 4, 6 and 7 follow: 1. The church will be compatible with the surrounding neighborhood. The Comprehensive Plan states that churches which are customarily a part of the total residential neighborhood environment may be permitted in low -density single family residential areas after a public hearing and City Council approval. 4. Required parking will be built in phases with Phase One providing parking for 16 vehicles. If the need warrants, additional parking for 32 vehicles will be constructed. The initial parking plan has been approved by the Traffic Manager. 6. Lighting of the parking lots will be located on the main structure and will be directed so that it will not go over the privacy fence into neighboring yards. 7. The north and east sides of the subject property will be screened and fenced with 8' tall wood screening fences and 10 2' wide landscape strips. The parking lot frontage along N.
