Richardson, Planning Manager SUBJECT: Consider a request for a zone change from GC-MD (General Commercial-Multiple Family Dwelling) District to RS (Residential Single Family Dwelling) District FILE: 1920-Z STAFF REPORT The Planning Manager recommends approval. Mark W. Whiteley & Associates is requesting a zone change from GC-MD (General Commercial-Multiple Family Dwelling) District to RS (Residential Single Family Dwelling) District for 9.9 acres located on the south side of Sarah, approximately 712 feet west of Warren. Antioch Missionary Baptist Church plans to develop the Jehovah Jireh Village Addition, a single family residential subdivision, on the subject property. Since single family homes are not permitted in the GC-MD District, a zone change is necessary. A preliminary plat of Phase One of this subdivision is on the November agenda. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES BEING a 9.9762 acre tract of parcel of land situated in the J. W. Bullock Survey, Abstract No.7, Jefferson County , Texas and being all of the Block 13 of the M.C. Cartwright subdivision, a subdivision of the City of Beaumont, Jefferson County, Texas, according to the plat there of recorded in Volume 4, page 194, Map Records, Jefferson County, Texas, save and except that certain called 0.228 acre tract of land as described in a "General Warranty Deed" LEGAL DESCRIPTION continued from the Katherin Belle B. Doyle Testamentary Trust, et al. to the City of Beaumont as recorded in Volume 2362, Page 314, Deed Records, Jefferson County, Texas, the same being that certain called 0.228 acre tract of land as described in a "General Warranty Deed" from Mary Pat Carlisi and Donald W. Heisig to the City of Beaumont as recorded in Volume 2366, Page 338, Deed Records, Jefferson County, Texas and being a portion of that certain 30 foot wide unnamed street situated in the said M.C. Cartwright Subdivision between Blocks 7 and 13 as vacated and abandoned by City of Beaumont Ordinance as recorded in Volume 1149, Pages 623, Deed Records, Jefferson County, Texas and being all of that certain tract of land as described in a "Special Warranty Deed" from Mary Pat Carlisi to Carlisi Et Al as recorded in Clerk's File No.2001037234, Official Public Records of Real Property and also of that certain called P. Bordages Account A tract as described in Clerks File No. 2000031588, Official Public Records of Real Property, Jefferson County, Texas, said 9.9762 acre tract being more particularly described as follows : Note: All bearings are based on the assumed bearing of North 9000'00" West for the South line of the said Block 13. BEGINNING at a 1/2" iron rod found for the Northeast corner of the tract herein described, said corner also being in the South right-of-way line of Sarah Street and being the Southeast corner of the above referenced 0.228 acre City of Beaumont tract and also being in the common line between Blocks 13 and 19, of the said M.C Cartwright Subdivision and also being in the West line of that certain called 5 acre tract of land identified as Tract No. 1 as conveyed to the City of Beaumont as recorded in Volume 1662, Page 148, Deed Records, Jefferson County, Texas; THENCE SOUTH 0000'10" WEST, for the boundary between the tract herein described and the said 5 acre City of Beaumont tract and that certain called 5 acre of land, identified as Tract No. 2, as conveyed to the County of Jefferson, Texas as recorded in Volume 1662, Page 148, Deed Records, Jefferson County, Texas, the same being the common line between the said Blocks 13 and 19, for a distance of 598.42 feet to an iron rod with a cap stamped "Faust" found for corner, said corner being the Southwest corner of the said 5 acre County of Jefferson tract, a point in the North line of that certain called 19.725 acre tract of land as described in a " Special Warranty Deed" from Bar C Ranch Company to Antioch Missionary Baptist Church as recorded in Clerk's File No. 2000027592, Official Public Records of Real Property, Jefferson County, Texas and corner being the common corner of Blocks 13, 14, 19 and 20 of the said M.C. Cartwright Subdivision; THENCE NORTH 9000'00" WEST, for the boundary between the tract herein described and the said 19.725 acre Antioch Missionary Baptist Church tract, the same being the common line between the said Blocks 13 and 14, for a distance of 727.19 feet to a 1/2" iron rod found for corner, said corner being the Northwest corner of the said 19.725 acre Antioch Missionary Baptist Church tract and being the Northwest corner of the remainder of that certain called Fourth Tract and the Southwest corner of that certain called Fifth Tract as described in a LEGAL DESCRIPTION continued "Warranty Deed" from J.L.C McFaddin and wife, Rosine Blount McFaddin to Bar C. Ranch Company as recorded in Volume 2054, Page 255, Deed Records, Jefferson County, Texas and said corner being in the centerline of the above referenced abandoned 30 foot wide street; THENCE NORTH 0002'01" WEST, for the boundary between the tract herein described and the said Bar C Ranch Company Fifth Tract, the same being the centerline of the said abandoned 30 foot wide street, for a distance of 596.46 feet to a 1/2" iron rod found for corner, said corner being in the South right-of-way line of Sarah Street and being the Northeast corner of the said Bar C Ranch Company Fifth Tract and being the Southwest corner of the above referenced 0.228 acre City of Beaumont tract; THENCE NORTH 8950'45" EAST, along and with the South right-of-way line of Sarah Street, a distance of 727.57 feet to the POINT OF BEGINNING and containing 9.9762 ACRES, more of less.
