Richardson, Planning Manager SUBJECT: Consider a request for a specific use permit to allow a youth recreational center in an RS (Residential Single Family Dwelling) District. FILE: 1899-P STAFF REPORT The Planning Manager recommends approval of this request subject the following requirement: 1. Install one landscape island within the northeast parking strip and with a waiver of the screening requirement along the north, south and west sides of the property (no fencing). Doug Canant, representing Jefferson County Drainage District #6, has applied for a specific use permit to allow a youth recreational center in an RS (Residential Single Family Dwelling) District. Mr. Canant states that DD#6 owns a 46.25 acre tract of land on Broad Oak Street. The District is currently in negotiations with the Philippine Association of Beaumont to trade 7.125 acres of this 46 acre tract to the Philippine Association in exchange for property they own on Milam Street. DD#6 would like to use the Milam Street property for a detention pond that would provide flood relief for the Corley Cartwright area of south Beaumont. DD#6 has come to terms with the Philippine Association and the land swap hinges on obtaining a specific use permit for the recreational center on the 7.125 acre tract. The proposed youth recreational center will include a 6,050 sq. ft. building which will house an office, conference room, assembly hall and classrooms. Another 8,500 sq. ft. building will house an indoor gymnasium. In addition, there will be four tennis courts, a recreation field with a jogging/walking track and several picnic sheds, playgrounds with picnic areas and a concrete parking area. A 100 ft. landscape buffer will be preserved between Broad Oak Street and the front parking areas. The recreational center will be private and utilized by the Philippine Association members and guests. Exhibits are attached. PUBLIC NOTIFICATION Notices mailed to property owners 16 . Dyches League, Abstract 17, Beaumont, Jefferson County, Texas, and also being out of that certain tract of land conveyed to Jefferson County Drainage District No. 6 as recorded in the Real Property Records of Jefferson County, Texas, File 2006016632 as tract 16 and being called 46.25 acres; said 7.125-acre tract being more particularly described by metes and bounds as follows: BEGINNING at a disc set in concrete found for the southeast corner of the tract herein described and the said 46.25 acre tract, and the most southerly southwest corner of that certain tract conveyed to The United States of America and recorded in the Deed Records Vol. 2330, Page 5 and being called 85.02 acres, and in the north right-of-way line of Broad Oak Street; THENCE south 57 05' 00" west, along the south line of the tract herein described, and the said 46.25-acre tract and the north right-of-way line of Broad Oak Street, a distance of 500.00' to an iron rod set for the southwest corner of the tract herein described; THENCE north 32 55' 00" west, along the west line of the tract herein described across the 46.25-acre tract, a distance of 669.68' to an iron rod set for the northwest corner of the tract herein described; THENCE north 57 05' 00" east along the north line of the tract herein described, across the said 46.25-acre tract, a distance of 436.00' to an iron rod set for the northeast corner of the tract herein described, in an east line of the said 46.25-acre tract, and a west line of that certain tract conveyed to The Big Thicket National Preserve, and recorded in the Real Property Records, File 2000021822 and being called 26.203 acres; THENCE south 35 03' 57" east, along an east line of the tract herein described and the said 46.25-acre tract, and a west line of the said 26.203-acre tract, a distance of 155.72' to a disc found in concrete at an angle point in the east line of the tract herein described, and the said 46.25-acre tract at the most southerly corner of the said 26.203-acre tract and the most easterly corner of the said 8.02-acre tract; THENCE south 39 22' 18" east along an east line of the tract herein described and the said 46.25-acre tract, and a west line of the said 85.02-acre tract, a distance of 517.35' to the PLACE OF BEGINNING containing 7.125 acres of land more or less. That the specific use will be compatible with and not injurious to the use and enjoyment of other property, nor significantly diminish or impair property values within the immediate vicinity; X 2. That the establishment of the specific use will not impede the normal and orderly development and improvement of surrounding vacant property; X X 3. That adequate utilities, access roads, drainage and other necessary supporting facilities have been or will be provided; X 4. The design, location and arrangement of all driveways and parking spaces provides for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the general public or adjacent developments; X 5. That adequate nuisance prevention measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration; X 6. That directional lighting will be provided so as not to disturb or adversely affect neighboring properties; X 7. That there are sufficient landscaping and screening to insure harmony and compatibility with adjacent property; and X X 8. That the proposed use is in accordance with the Comprehensive Plan. X ANALYSIS continued This application is in conformance with all eight conditions necessary for approval. Comments on Conditions 2 and 7 follow: 2. The surrounding vacant property is owned by the U.S. Government and DD#6. The federal property is part of the Big Thicket National Preserve and will not be developed. DD#6 currently has no development plans for its property. If and when it is developed, it will most likely be for some type of future mitigation effort. 7. The surrounding property on the north, south and west sides of the subject property are zoned RS. Typically, an 8' tall wood screening fence and a ten foot landscape strip would be required. DD#6 owns the property to the west and south. The property to the north is owned by the U.S. Government. The applicant is requesting a waiver of the requirement to construct the 8' fence. The Planning Manager recommends approval of that waiver. An additional landscape strip will also be required in the northwest parking strip.
