Richardson, Planning Manager SUBJECT: Consider a request for a specific use permit to allow a skilled nursing home in a GC-MD-2 (General Commercial-Multiple Family Dwelling) District. FILE: 1865-P STAFF REPORT The Planning Manager recommends approval of this request subject to the following condition: 1. A sidewalk will be required along Major Drive. (Planning) James Moore with Centex Management Co. is requesting a specific use permit to allow a skilled nursing facility on 5.74 acres of property located on the east side of S. Major, approximately 267' south of Pevitot. City Council rezoned this property and an additional 35.26 acres to GC-MD-2 in January, 2007. The 45,000 sq. ft., 120 bed skilled nursing home is the first of at least two medical related facilities that are proposed on the 41 acres. LEGAL DESCRIPTIONS FOR ORDINANCE PURPOSES BEING a 5.6046 acre tract or parcel of land situated in the Charles Williams Survey, Abstract No. 59, Jefferson County, Texas, and being out of and part of that certain 41.031 acre tract of land as described in a A Warranty Deed with Vendor=s Lien @ from Harold Lee Richardson to George A. Dishman, Jr and James C. Dishman as recorded in Volume 2330, Page 425, Deed Records, save and except that certain called 0.288 acre tract of land as described in a deed from George A. That adequate nuisance prevention measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration; X 6. That directional lighting will be provided so as not to disturb or adversely affect neighboring properties; X 7. That there are sufficient landscaping and screening to insure harmony and compatibility with adjacent property; and X 8. That the proposed use is in accordance with the Comprehensive Plan. X ANALYSIS continued This application is in conformance with all eight conditions necessary for approval. Comments on Conditions 1 and 3 follow: 2. In January, 2007, City Council approved GC-MD-2 zoning for 41 acres of land that includes the subject property. Medical related uses are proposed for some, if not all, of the 41 acres. The nursing facility will be compatible with the other proposed development on the overall tract. 3. DD#6 is interested in how the drainage of the subject property will be handled. DD#6 states that drainage will most likely involve the Major Drive drainage system. If so, the drainage will require TxDOT approval. DD#6 suggests that platting of the entire 41 acres as soon as possible to determine the overall drainage system.
