Richardson, Planning Manager SUBJECT: Consider a request for a specific use permit to allow a church in the CBD (Central Business District FILE: 1946-P STAFF REPORT The Planning Manager recommends approval subject to the following conditions: 1. Provide a minimum 6' wide landscape strip along the Magnolia Street frontage and a 3' wide landsape strip along the McFaddin Avenue frontage of the parking lot. Interior landscape islands will also be required as per the Zoning Ordinance. 2. No overnight shelter or public feedings will be allowed without a future specific use permit. Pastor Kennedy Andrews, representing Harvest for Lost Souls Outreach Church, has applied for a specific use permit to allow a church in the CBD (Central Business District). The property is located at 934 Calder. The church proposes to convert the old YMCA racquet ball gym into its sanctuary. The interior of the building will be renovated to house staff offices, classrooms and a sanctuary that will seat 200 people. Pastor Andrews states that parking will be provided on the old tennis courts west of the old gym building and the existing parking lot. However, the YMCA has stated that its existing parking lot will not be available for church parking. The old tennis courts will be able to meet the parking needs of the church. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES Being Tract 2, Block 2, Tract 2, Block 3 and Lots 7-9, Block 1, Fuller-Keith Addition, City of Beaumont, Jefferson County, Texas, containing 2.50 acres, more or less. That adequate utilities, access roads, drainage and other necessary supporting facilities have been or will be provided; X 4. The design, location and arrangement of all driveways and parking spaces provides for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the general public or adjacent developments; X X 5. That adequate nuisance prevention measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration; X 6. That directional lighting will be provided so as not to disturb or adversely affect neighboring properties; X 7. That there are sufficient landscaping and screening to insure harmony and compatibility with adjacent property; and X X 8. That the proposed use is in accordance with the Comprehensive Plan. X ANALYSIS continued This application is in conformance with seven of the eight conditions necessary for approval. Comments on Conditions 1, 4 and 7 follow: 1. The proposed church is complimentary to and will not be detrimental to other uses in the CBD. The CBD is home to a number of churches. 4. Pastor Andrews states that the old tennis courts and the existing parking lot would be used for church parking. The YMCA has stated that its parking lot will not be available for church parking. 7. A new parking lot would be required to have a 6' wide landscape strip along all street frontages and interior landscape islands. There is adequate room for landscaping along the Magnolia Street frontage. Along the McFaddin Avenue frontage, there is only 3' of ground between the parking lot and the sidewalk. The Planning Manager recommends a 6' wide landscape strip along Magnolia and a 3' wide landscape strip along McFaddin. Interior landscape islands are also recommended.
