Richardson, Planning Manager SUBJECT: Consider a request for an amended specific use permit to allow the expansion of an existing church in a RS (Residential Single Family Dwelling) District FILE: 1935-P STAFF REPORT The Planning Manager recommends approval. Unity Church of Beaumont has applied for an amended specific use permit to allow the expansion of an existing church in a RS (Residential Single Family Dwelling) District. The property is located rd at 1555 S. 23 Street. An 1,800 sq. ft. addition will be constructed on the south side of the existing church building. Reverend von Gyllenband states that the addition will serve the young people of the church. In August, 2000, City Council approved a specific use permit for Unity Church. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES Being a 10.292 acre tract of land out of and a part of Block 37 of the Cartwright and Roberts Subdivision A A @, said tract being more particularly described as follows: Beginning at a point 140' south of the southeast corner of the rd intersection of Cartwright Avenue with the 80' wide 23 Street right-of-way, said point being in the southwest corner of Lot 1, Block 8, Washington Manor Addition, Unit 3, Beaumont, Texas, Jefferson County Map LEGAL DESCRIPTION continued Records Volume 9, Page 195; thence west a distance of 10' to a point rd in the east right-of-way line of the 23 Street 60' wide right-of-way; thence south along the east right-of-way line of the 60' rd wide 23 Street a distance of 356', more or less, to the Place of Beginning of the subject 10.292 acre tract, being the northwest rd corner of the aforesaid tract; thence south along the 23 Street east right-of-way line a distance of 366' to a point for corner in the southwest corner of the 10.292 acre tract; thence east along the south line of the aforesaid tract a distance of 1060' to a point for corner in the west line of the relocated Hillebrandt Bayou, a 160' wide DD#6 drainage facility; thence northeast along the Bayou a distance of 491' to a point for corner; thence west a distance of 1388' to the northwest corner of the aforesaid tract, being the Place of Beginning. That the specific use will be compatible with and not injurious to the use and enjoyment of other property, nor significantly diminish or impair property values within the immediate vicinity; X X 2. That the establishment of the specific use will not impede the normal and orderly development and improvement of surrounding vacant property; X X 3. That adequate utilities, access roads, drainage and other necessary supporting facilities have been or will be provided; X 4. The design, location and arrangement of all driveways and parking spaces provides for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the general public or adjacent developments; X 5. That adequate nuisance prevention measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration; X 6. That directional lighting will be provided so as not to disturb or adversely affect neighboring properties; X 7. That there are sufficient landscaping and screening to insure harmony and compatibility with adjacent property; and X X 8. That the proposed use is in accordance with the Comprehensive Plan. X X ANALYSIS continued This application is in conformance with all eight conditions necessary for approval. Comments on Conditions 1, 2, 7 and 8 follow: 1. The site contains over 10 acres. The property allows adequate space for the expansion without impacting the surrounding area. Much of the property remains in its natural wooded state. 2. The existing church has not impeded the normal and orderly development of the vacant RS zoned land surrounding the church site to the north and west. Churches are assets to developing residential areas if designed and sited so as to not interfere with neighborhood growth. The church has ample room to expand. 7. A buffer of existing trees have been left along the north and east property lines to screen the church. 8. The proposal is in conformance with the Comprehensive Plan. The Comprehensive Plan designates the site as a A Stable Area @.
