STAFF REPORT
The Planning Manager recommends that all requirements be met as of
January 1, 2009, or the specific use permit will be recommended for
revocation and the church would need to reapply.
On November 11, 2003, Rev. Harmon Dent applied for a specific use
permit to allow a church in an RS (Residential Single Family Dwelling)
District. The property is located at 1575 Montrose.
The specific use permit was approved subject to the following
conditions:
1. As per parking calculations, seating capacity shall not
exceed 312 seats.
2. Drainage plans shall be submitted to and approved by the
City Engineer.
In addition to those conditions, the construction drawings were
approved with specific requirements. Many of those
requirements have not been met. More specifically:
1. The parking lot is paved with asphalt.
2. The parking lots are 54' wide and 125' in length. The
width and length do not adequately provide for two rows
of 18' deep parking stalls and a 24' wide driveway nor
adequate room for the number of parking spaces shown on
the construction plans.
3. Landscaping along the parking lot frontage is not
installed.
4. The driveway widths shall not exceed 35'. The left drive
is 45' wide and the right drive is 40'. The driveway was
revised and installed with no approvals by the City. A
minimum 10' radius for the driveways has not been met.
5. There are no handicap parking spaces and no handicap ramp.
6. The 10' wide landscape strips along the north and east
sides have not been installed.
7. The specific use permit show 78 parking spaces. The
construction drawings show 59 parking spaces. One of the
complaints from neighbors is that adequate parking has
not been provided to meet the needs of the church. On
a number of occasions, cars have parked along Montrose,
thereby creating traffic hazards.

Community Development staff feels that the church has had more
than adequate time to meet all conditions for construction.
