SUBJECT: Consider a request for a specific use permit to allow a paint and
body shop in a GC-MD (General Commercial-Multiple Family
Dwelling) District

STAFF REPORT
The Planning Manager recommends approval subject to the following
conditions:
1. An 8' tall wood screening fence shall be installed along
the east property line.
2. A minimum of five parking spaces shall be provided on the
subject property.
3. All body and fender repairing shall be done within a
completely enclosed building or room with stationary
windows that may be opened only at intervals necessary
for ingress and egress.
4. No spray painting may be done except in a building or room
specially designed for that purpose.
5. All other auto repairing, etc., shall be conducted within
a building enclosed on at least three sides.
6. The paint and body shop shall meet all state and federal
environmental requirements.
7. The new paint and body shop must be setback a minimum of
fifteen feet from the side property line on Blanchette
or get a variance to the setback requirement from the Board
of Adjustment.

9. Construct sidewalks along the entire frontage of 4 St.
George A Eddie @ Randle, Jr. has applied for a specific use permit
to allow a paint and body shop in a GC-MD (General
Commercial-Multiple Family Dwelling) District. The property

is located at 1297 4 Street.
Mr. Randle proposes to construct a new 1570 sq. ft. building
that will be used for a body and paint shop. An existing storage
shed at the rear of the property will be demolished. Mr. Randle
states that the existing building at the front of the property
will be used for the storage of supplies. The business will
be open 8 a.m. - 5 p.m., Monday through Friday. There will
be three employees working at the business. Signage for the
business will be installed on the building.

Mr. Randle proposes to build the new paint and body shop on
an existing slab. The building that was there has been
demolished. The slab is approximately two feet from the side
property line. A fifteen foot building setback is required.

This application is in conformance with six of the eight conditions
necessary for approval. Comments on Conditions 1,4, 5 and 7
follow:

1. This section of S. 4 St. contains a number of heavy
commercial uses. The paint and body shop will be similar
in intensity to other uses within near proximity.
4. The Zoning Ordinance requires a minimum of five parking
spaces. Four parking spaces are shown. There is ample
room on the property to provide additional parking spaces.
5. The Zoning Ordinance requires that all paint and body work
shall be done within a completely closed building or room
with stationary windows that may be opened only at
intervals necessary for ingress and egress. No spray
painting may done except in a building or room specially
designed for that purpose. All other auto repairing, etc.
shall be conducted within a building enclosed on at least
three sides.
7. The subject property is adjacent to RM-H zoning on the
east side. A five foot tall chain link fence runs along
that property line. The Zoning Ordinance requires an
eight foot wood screening fence and a ten foot wide
landscape strip along the east property line. A concrete
slab is located almost up to that property line.
Therefore, the Planning Manager is recommending the
construction of an eight foot wood screening fence and
a modification to the landscaping requirement (no ten foot
landscape strip along the east property line). In
addition, the parking lot must meet the landscaping

requirements along 4 St. and Blanchette Street.
