STAFF REPORT
Andrew Kasparek on behalf of Verizon Wireless is requesting a Specific Use Permit to allow the
applicant to construct a cellular communications site including a 80 ft. tall monopole tower,
located on a 0.0826 acre lease site, at 1188 Fannin Street. This site meets the distance
requirement from residentially zoned property and will be constructed to city and federal
standards. In addition, Verizon will enclose the equipment with an eight (8) foot wood privacy
fence. As the site is located within the Martin Luther King Urban Corridor/Downtown District,
and is highly visible from the road, landscaping of the lease site is recommended.
The applicant states that this tower will help provide additional coverage and capacity to the
customers in the area, and would be used for emergency services.
Staff recommends approval with the following condition:
1. A ten foot wide landscaped buffer shall be installed outside of the 8 foot fence for the entire
perimeter of the lease site.
Please note that final occupancy approval is subject to review and acceptance of submitted plans
and field inspections to verify compliance with applicable codes.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
A Meets & Bounds description of a certain 0.0826 acre tract of land situated in the Noah Tevis
Survey, Abstract No. 52 in Jefferson County, TX being out of Lots 7 & 8, Block 56 of the
Wormer Addition, plat of which is recorded in Volume 1 Page 16 of the Jefferson County Map
Records conveyed to Sitton Commercial Properties, LLC by special warranty deed recorded in
Clerks file # 2011007264 of the Jefferson County official public records of Real Property; said
0.0826 are tract being more particularly described as follows with all bearings being based on the
Texas Coordinate System, South Zone NAD 83
Commencing at a found ¾ inch iron rod at the westernmost corner of said lot 7 and a proposed
0.0143 acre tract, being common with the intersection of Victoria St, aka Rachford and an
unnamed alley both recorded in said Volume 1, page 16, from which a found 5/8 inch iron rod
bears North 43’51’13” West, 160 feet and a found 5/8 inch iron rod bears South 46’58’07” West,
60.27 feet.
Thence, North 46’08’47” East, along the northwesterly lines of said lots 7 & 8 and proposed
0.0143 acre tract, common with the southeasterly line of said unnamed alley, 65 feet to the
northernmost corner of proposed 0.0442 tract.
Thence, South 43’51’13” East, along a northeasterly line of proposed 0.0143 acre tract, 5 feet to
a set 5/8 inch iron rod for the point of beginning of the herein described tract.
Thence, South 43’51’13” East 60 feet to a set 5/8 inch iron rod.
