SUBJECT: Request for approval of a certificate of appropriateness to allow
a 6' tall wood privacy fence in the required front yard

STAFF REPORT
The Planning Manager recommends denial of this request.
Bradley and Jennifer Stevens started construction of a 6' tall wood
privacy fence in the front yard of a portion of their property without
a certificate of appropriateness. The house is located at 2311 Pecos.
The Stevens= own three lots. The new fence is located to the west of
the main structure.
The Stevens= state that the need for the fence has stemmed from
events involving the theft of their lawn mower and trespassing by
people and large dogs. They feel that the fence is necessary for the
safety of their children and property.
Sec. 30.21-2 of the Zoning Ordinance states that within the front
yard, no solid fence or wall shall be erected to exceed a height of four
feet. The ordinance also states that a fence not in compliance with
the ordinance may be approved if the applicant establishes the fence
is historically sensitive or unless the absence of said fence poses a
significant hazard to life or property.
The house is not listed in the SPARE Beaumont survey.
