SUBJECT: Request for approval of a certificate of appropriateness to allow
a paved parking area in the front yard.

The Planning Manager recommends denial of this request.
Irma Carbajal is requesting a certificate of appropriateness to allow the
construction of a paved parking area in the front yard of her property
at 1940 Harrison.
Ms. Carbajal states that she inquired at City Hall about the need for a
building permit to construct a paved parking area in her front yard.
She did not talk to Building Codes or Planning. She states that
whomever she talked to told her that as long as there was no curb-cut
for a driveway apron, there was no need for a building permit. That
is true for all of the city except for the Historic District. Based upon
that information, she constructed the parking area.
After construction, Anna Varela, the City=s Historic District Code
Enforcement Officer, noticed the parking area and cited Ms. Carbajal.
Ms. Carbajal states that due to poor street drainage in front of her
house, it affects how her property drains. The front yard stays wet
and nothing will grow. In addition, Ms. Carbajal says that her
daughter is deaf and she is afraid for her daughter to ride her bike in
the street. This paved area provides her daughter a place to ride her
bicycle.
Section 30-21.2 state that parking in the front yards is not
permitted without a certificate of appropriateness.
