SUBJECT: Request for a variance to the side yard building setback from 5'
to 2' 6".

STAFF REPORT
Gerald Freedman is requesting a variance to the side yard building
setback in order to build a garage at his residence at 3782 Champions
Drive. The variance request is from 5' to 2' 6".
Mr. Freedman states that insufficient space remains to build a
standard garage. The repositioning of the proposed garage to meet
the ordinance would result in excessive overlap to the front of the
existing house.
Deed restrictions for Willow Creek Country Club Estates require that
approval be obtained from the residential committee responsible for
any alterations to property within the subdivision. Approval was
granted by the committee in April, 2005.
The applicant shall have the burden of proof that all three conditions
necessary for the approval of a variance have been met.
