SUBJECT: Request for a variance to the minimum side yard building
setback from 10' to 7.75' for an addition to a house.

STAFF REPORT
Mr. and Mrs. Harold Smalley, the property owners, are requesting a
variance to the minimum side yard building setback from 10' to 7.75'
to allow the construction of a 266 sq. ft. addition onto the west side
of their home at 6095 Calder. The addition will be used for storage
and a therapeutic spa.
The Smalleys state that the interior layout of the home dictates that
the addition be positioned where proposed. It will be aligned with the
angle of the house. The addition will be located behind a permanent,
brick column fence and will be located 26.25' from the edge of the
pavement of Langham.
The site plan shows water and electrical lines along the west property
line. The Planning Division has discussed this request with both the
City=s Water Utilities Division and Entergy. Neither has any problem
with the request.
The applicant shall have the burden of proof to demonstrate that all
three conditions necessary for a variance have been met.
