Richardson, Planning Manager SUBJECT: Request for a variance to the minimum side yard building setback from 10' to 5' FILE: 535-BA STAFF REPORT Sigma Engineers, Inc., the applicant on behalf of Christo Rey Catholic Church, is requesting a variance to the minimum side yard building setback from 10' to 5' for an addition to the church at 767 Avenue A. Christo Rey Catholic Church is wishing to construct two additions to the sanctuary. An approximately 684 sq. ft. addition will be located on the south side and an approximately 795 sq. ft. addition will be located on the north side. The north side addition is the one for which the variance is being requested. The applicant states that two additions were added to the church in 2003. The 250 sq. ft. addition on the north side was constructed to within 5' of the north property line. An investigation of the building permit records shows that no building permits were granted for either addition. The addition under consideration would line up with the 2003 addition constructed on the north side of the church. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval of a variance have been met. Exhibits are attached.
