SUBJECT: Request for variances to the minimum side yard building setback
from 5' to 4' 5" and to the minimum rear yard setback from
25' to 18' 4"

STAFF REPORT
Slade Smith is proposing to construct a 500 sq. ft. master bedroom
and bath onto the rear of his house at 3850 Hyde Park Row. The
18' x 28' 7 2" addition will extend into the side yard 7" and into the
rear yard 6' 6".
The Zoning Ordinance requires a 5' side yard setback for one story
structures. The existing house already encroaches 7" into the side
yard setback. The addition will line up with the existing house.
The required 25' rear setback may be reduced to 15' if there are no
accessory buildings of any type located in the reduced rear yard.
According to the site plan, there is a detached garage within
approximately 4' 6" of the rear property line. Therefore, the 25'
setback requirement would apply.
The applicant shall have the burden of proof to prove that all three
conditions necessary for the approval of a variance have been met.
