SUBJECT: Request for a variance to the minimum side yard building
setback from 7.5' to 5'

STAFF REPORT
David Roskos, representing L & F Homes, is requesting a variance to
the minimum side yard building setback from 7.5' to 5' for a two
story residential structure to be built at 1043 Vermont.
Mr. Roskos states that the duplex structure will be approximately
3,800 sq. ft. in size and will include four bedrooms. The minimum
side yard setback for a one story structure is 5'. For two story
structures, the minimum side yard setback is 7.5'.
Mr. Roskos states that this structure and one on Iowa are the first of
several residential structures that L & F intends to build in this area.
The intent of the developer is to cater to students attending Lamar
University.
The applicant shall have the burden of proof to demonstrate that all
three conditions necessary for approval have been met.
