Richardson, Planning Manager SUBJECT: Consider a request for a variance to the minimum side yard building setback from 7.5 to 3' FILE: 579-BA NOTE: This item was tabled at the November 6, 2008 meeting due to the absence of the applicant. STAFF REPORT Stan Wolfrom Homes, Inc. has applied for a variance to the minimum side yard building setback from 7.5' to 3'. The property is located at 5010 Eaheart Circle. The property owner wishes to add a second story to the existing detached garage. In addition, the existing breezeway would be enclosed. The garage is currently 3' at its closest point to the side property line. The Zoning Ordinance requires that two story structures be set back from a side property line a minimum of 7.5'. To meet the setback requirement, Mr. Wolfrom states that the shape of the property would require the demolition and relocation of the garage. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Exhibits are attached.
