Richardson, Planning Manager SUBJECT: Consider a request for a variance to the minimum front yard building setback from 15' to 13.3' for a single family residence FILE: 597-BA STAFF REPORT Felix Jones Jr. has applied for a variance to the minimum front yard building setback from 15' to 13.3'. The property is located at 4680 Prairie. Mr. Jones states that he is in the process of refinancing his home loan and the title company required a survey to close the loan. At that time, it was discovered that the house encroached into the front yard building setback 1.9'. According to building permit records, the house was completed in July, 2008. Those records show that no foundation inspection was asked for during construction. Therefore, the City made no inspections. Normal procedure is for the building contractor to contact the City for inspections at the various stages of construction.. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Exhibits are attached.
