Richardson, Planning Manager SUBJECT: Consider a request for a variance to the minimum setback for an owner identification sign from 15' to 4' FILE: 595-BA STAFF REPORT Thuy Truong has applied for a variance to the minimum setback for an owner identification sign from 15' to 4'. The property is located at 7995 Hwy. 105. In November, 2002, City Council approved a specific use permit to allow a beauty /nail shop on the subject property. Ms. Truong states that to erect the sign at the required setback would require that the lone oak tree on the property would have to be cut done for the sign to be seen from the highway. She says that her sign at this location would line up with neighboring signs. For non-residential uses in the RM-H District, the Zoning Ordinance allows one detached owner identification sign that shall not exceed 50 sq. ft. in area and 15' in height and shall be located a minimum of 15' from any property line. A site inspection of the subject property shows that Ms. Truong=s existing sign is approximately 2' from the front property line. The sign for the dentist office, to the east, is approximately 15' from the front property line. There also appears to be adequate room to move the sign to the required 15' and not have to cut down the aforementioned oak tree. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for approval have been met. Exhibits are attached.
