STAFF REPORT
Mahesh Wadhwa has applied for a variance to the minimum yard setback from
5' to 0' for a new convenience store to be built at 1050 IH-10 South.
Mr. Wadhwa states that the existing building on the property will be
demolished to make way for the new convenience store. The property has
been subdivided to create a lot to fit a convenience store with gas pumps.
Mr. Wadhwa says that the property is exceptionally small and narrow and
the shape of the lot makes it difficult to meet the requirements of Chevron.
The location where the encroachment occurs is near an existing motel
building. Because of this close proximity between buildings, the property
owner is proposing a 2-hour fire rated wall.
The applicant shall have the burden of proof to demonstrate that all three
conditions necessary for approval have been met.
