SUBJECT: Consider a request for a variance to the minimum rear yard
building setback from 15' to 13.14'

STAFF REPORT
Brandon Geis, representing Kinsmen Homes, LLC, has applied for a
variance to the minimum rear yard building setback from 15' to
13.14'. The property is located at 1750 Meadow Run.
Mr. Geis states that the bay window on the rear of the house was
inadvertently placed 1.86' beyond the rear building setback line.
When the house was being laid out, the surveyor measured to the
main body of the house and not to the rear most bay window to
verify compliance with the rear building line.
Mr. Geis says that the house is approximately 60% complete and all
other remedies to correct this issue would adversely affect the existing
foundation and structure if made to comply. He does not feel that
the encroachment would affect any neighbors or the desired look of
the subdivision.
The applicant shall have the burden of proof to demonstrate that all
three conditions necessary for approval have been met.
