STAFF REPORT
Fellicia Young, for Jehovah Jireh Village Community Development Center, Inc., is
requesting a variance to the minimum front yard building setback from 25’ to 24.5’. The
property, located at 4235 Rohi Street, is located in the RS (Residential Single Family
Dwelling) zoning district. This requires a 25’ minimum front yard setback. The building,
as constructed, does not meet this requirement. It is unclear how this happened. It may
have been the result of the front of the parcel being a curve, which means that there is
some reasonable question as to where the property line should be measured from.
However, the most recent survey puts the building six inches too close to the property
line, which is why a variance is required.
The developer’s responses to the conditions for granting a variance focus on the expense
and difficulty of changing the building at this point. The encroachment into the required
setback is minimal, so the developer notes that the spirit of the ordinance could be
maintained (i.e., it is not an obvious and egregious exception to the standard). The
developer also notes that it will be costly to demolish and reconstruct the home.
The applicant shall have the burden of proof to demonstrate that all three conditions
necessary for approval have been met.
