SUBJECT: To consider a request for a variance to the minimum front yard building setback
from 25’ to 7’.

STAFF REPORT
Johnny T. Fulton is requesting a variance that will allow him to construct a carport in his
front yard at 157 Briggs Street. Due to the configuration of steps from the door accessing
his garage, two (2) cars cannot be parked in his garage at once. Being a disabled veteran
suffering deterioration of his bones, a carport would allow him and his wife to both park
under a protected covering.
Section 28.03.024 (c)(13) of the Zoning Ordinance states:
Where an existing residential structure does not contain a garage or carport and
where there is not adequate area for an accessible parking space behind the front
yard area, a carport having no side walls may be constructed in the front yard
area.
Mr. Fulton cannot use this exception because his house has an existing garage, therefore
he is requesting a variance to the front yard setback. The minimum front yard setback in
a RS (Residential Single Family Dwelling) District is 25 feet. Mr. Fulton is asking to
build 7 feet from his front property line.
The applicant shall have the burden of proof to demonstrate that all three conditions
necessary for a variance have been met.
