STAFF REPORT
Sam Bevilacqua of Bevilacqua Construction, is requesting a Special Exception to the minimum
rear yard setback from 25' to 15’. Mr. Bevilacqua is building a new home at 18 Stone Brook
Court. The majority of the neighboring structures do not meet city requirements. Section
28.02.005(e)(2)(B)(i) states the board may grant, "...a rear yard exception where the actual rear
yard setback of any four (4) or more lots in the same block do not meet the rear yard
requirements . . ."
