FILE: 715-BA STAFF REPORT Gary Wallace is requesting a variance to the side setback at 4220 Treadway Road. The property is zoned GC-MD (General Commercial - Multiple Family Dwelling) and is located adjacent to property zoned RM-H (Residential Multiple Family Dwelling - Highest Density). The ordinance states that when commercial zoned property is adjcent to residential zoned property, the side setback increases from 5 feet to 20 feet. The existing commercial structure on the property sits 10 feet from the side property line. The property owner would like to expand the existing structure and maintain the existing setback. Therefore, the request is to allow a variance to the required 20 foot setback to allow a 10 foot setback. The applicant shall have the burden of proof to demonstrate that all three conditions necessary for a variance have been met. Exhibits are attached.
