Smith Councilman Audwin Samuel Also present: Stephen Richardson, Planning Manager; Carla Gigliotta, Recording Secretary; Tyrone Cooper, City Attorney; Chris Boone, Community Development Director APPROVAL OF MINUTES Commissioner Senigaur made a motion to approve the minutes of the Regular Meeting and Joint Public Hearings held June 21, 2010. Commissioner Craig seconded the motion. Motion to approve carried 6:0. Planning Commission July 19, 2010 REGULAR MEETING 1) Replat - Helbig Estates, Phase One: Request for a replat of a 2.96 acre tract out of part of Lot 46, Beaumont Improvement Co. Addition into Helbig Estates, Phase One. Location: North side of Maida, between Bigner and Barrett Applicant: Faust Engineering & Surveying, Inc. Mr. Richardson presented the staff report. Faust Engineering has applied for the replat of a part of Lot 46 into Helbig Estates, Phase One, a 14 lot single family subdivision. The property is located on the north side of Maida Road, immediately west of the unimproved Betsy Road right-of-way. The master plan for the entire subdivision shows thirty-four lots being served by a single outlet street. The Subdivision Regulations allow no more than thirty-two lots being served by a single outlet street. Upon approval of future phases, the developer will need to reduce the total number of lots by two or the Planning Commission must grant a variance to the maximum number of lots. Mr. Richardson recommended approval subject to the following conditions:  Provide an underground pipe conveyance within the Betsy Road right-of-way to the natural gully. (Public Works)  Install street name signs, stop signs and end-of-roadway markers within the subdivision. At Highly Favored Lane and Maida Road, a dual A dead end blade (W14-1a) is required. Street marker signs identifying the streets of Highly Favored Lane, Anointed Lane and Prosperity Lane shall be provided to City of Beaumont standards. Stop signs shall be provided at the intersections of Highly Favored Lane and Maida Road and Prosperity Lane and Highly Favored Lane. (Transportation)  Where the culverts tie into the natural drain ditch, DD#6's standard erosion control detail will need to be installed. (DD#6)  All of the final drainage design and plans will be approved by DD#6 and the City of Beaumont. (DD#6)  Depending upon the design of the ditch along Maida, additional right-of-way may be required to be dedicated to accommodate the ditch. (DD#6 and Engineering) 2 Planning Commission July 19, 2010 Twenty notices were mailed to property owners within 200 feet and within the same subdivision. Two responses in favor and none in opposition were returned. Chairman Makin opened the public hearing and asked for comments. Jeremy Mitchell of Faust Engineering addressed the Commission. Chairman Makin asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Motion to approve carried 6:0. 2) File 763-OB: Request for a waiver of the sidewalk requirement along the frontage of the BISD Agricultural Facility. Location: 6150 Keith Road Applicant: Rob Clark/Architectural Alliance, Inc. 3 Planning Commission July 19, 2010 Mr. Richardson presented the staff report. In June, City Council approved an amendment to the Subdivision Regulations that allows the Planning Commission to grant a waiver to the sidewalk requirement if the applicant can prove that there is an engineering reason for installing the sidewalk. Rob Clark, architect for the project, states that his request is based on issues related to construction, maintenance and pipeline restraints for this location. He states that since the drainage along Keith Road is open, the ditches and maintenance of said ditches would destroy any new sidewalk construction. In addition, pipeline easements run parallel and adjacent the full length of the property frontage thereby restricting construction interference with the easements. Finally, entry to the agricultural facility is vehicle entry only. There is no pedestrian access to this facility from Keith Road. Mr. Richardson recommended approval of the request.. Chairman Makin asked for the applicant=s comments. Rob Clark with Architectural Alliance addressed the Commission. Chairman Makin asked for comments in favor or in opposition. No comments were made. Commissioner Mason made a motion to approve a waiver of the sidewalk requirement along the frontage of the BISD Agricultural Facility at 6150 Keith Road as requested in File 763-OB. Commissioner Craig seconded the motion. Motion to approve carried 6:0. JOINT PUBLIC HEARING Mayor Ames called the Joint Public Hearings of July 19, 2010 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Makin. She explained the policies and procedures for the hearing process. 1) File 2039-P: Request for a specific use permit to allow a child care facility in an RS (Residential Single Family Dwelling) District. Location: 2410 Louisiana Applicant: Tiffany Smith Mr. Richardson presented the staff report. The applicant, Mrs. Smith, 4 Planning Commission July 19, 2010 states that she operates a 24-hour child care facility that is licensed by the Texas Department of Family and Protective Services for up to twelve children. She states that the facility provides daytime, evening and overnight care. It is run by herself, her husband and an assistant. In June, City Council approved an amendment to he Zoning Ordinance that permits child care facilities in the RS District with a specific use permit. Mr. Richardson recommended approval subject to the following conditions:  The number of outside employees shall be limited to one.  The total number of children to cared for shall not exceed twelve. Seventeen notices were mailed to property owners within 200 feet. One response in favor and none in opposition were approved. Slides of the subject property were shown. Chairman Makin opened the public hearing and asked for the applicant=s comments. Tiffany and Kevin Smith, the applicants, addressed the Commission. Chairman Makin asked for comments in favor or in opposition. Stewart Yoes, 3535 Calder, addressed the Commission. The public hearing was closed. Commissioner Senigaur made a motion to approve a specific use permit to allow a child care facility in an RS District at 2410 Louisiana as requested in File 2039-P, subject to the following conditions:  The number of outside employees shall be limited to one.  The total number of children to cared for shall not exceed twelve at any one time. Commissioner Craig seconded the motion. Motion to approve carried 6:0. 2) File 762-OB: Request for a street name change from Lakeside Drive to N. Lakeside Dr., E. Lakeside Dr., W. Lakeside Dr. and S. Lakeside Dr. Location: Lakeside Drive in The Crescent on Walden, Phase II, a 5 Planning Commission July 19, 2010 subdivision north of Walden Road Applicant: City of Beaumont Planning Division Mr. Richardson presented the staff report. In June, 2003, the final plat for the The Crescent on Walden, Phase II was recorded. The subdivision is served by Lakeside Dr., a circular street. The addressing scheme for the subdivision was to use the lot number as the addresses. It later became apparent that the lot numbers could not used, so an attempt was made to apply house numbers to the plat. However, issues arose due to the loop street creating duplicate numbering. After much debate, it was decided the simplest solution is to change the street name so that duplicates are avoided. Mr. Richardson recommended approval of the request. Thirty-four notices were mailed to property owners adjacent to the street. No responses in favor or in opposition were returned. Chairman Makin opened the public hearing and asked for comments. No comments were made. The public hearing was closed. Commissioner Senigaur made a motion to a street name change from Lakeside Drive to N. Lakeside Dr., E. Lakeside Dr., W. Lakeside Dr. and S. Lakeside Dr. located in The Crescent on Walden, Phase II, a subdivision north of Walden Road as requested in File 762-OB. Commissioner Craig seconded the motion. Motion to approve carries 6:0.
