Pate Also present: Steve Richardson, Planning Manager; Jill Cole, Recording Secretary; Adina Ward, Planner; Tyrone Cooper, City Attorney; Chris Boone, Community Development Director APPROVAL OF MINUTES Commissioner Kyles made a motion to approve the minutes of the Joint Public Hearings held September 19, 2011. Commissioner Bodwin seconded the motion. Motion to approve carried 7:0. JOINT PUBLIC HEARINGS Planning Commission October 17, 2011 Mayor Ames called the Joint Public Hearings of October 17, 2011 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Makin. Chairman Makin explained the policies and procedures for the hearing process. 1) File 2109-Z: Request for a zone change from HI (Heavy Industrial) District to GC-MD (General Commercial-Multiple Family Dwelling) District or more restrictive district. Location: 1585 Calder Applicant: Soutex Surveyors, Inc. Mr. Richardson presented the staff report. The subject property is zoned HI while the rest of the owners= property is zoned GC-MD. The property owners wish to have all of their property under the same zoning so that when they develop it, it will have uniform building setbacks. Mr. Richardson recommended approval. Seven notices were mailed to property owners within 200 feet. One response in favor and none in opposition were returned. Slides of the subject property were shown. Chairman Makin opened the public hearing and asked for the applicant=s comments. George Newsome of Soutex Surveyors, the applicant, addressed the Commission. Chairman Makin asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Craig made a motion to approve a zone change from HI (Heavy Industrial) District to GC-MD (General Commercial-Multiple Family Dwelling) District at 1585 Calder as requested in File 2109-Z. Commissioner Kyles seconded the motion. Motion to approve carried 7:0. 2) File 2110-P: Request for an amended specific use permit to allow an expansion of church parking in an RM-H (Residential Multiple Family Dwelling-Highest Density) District. 2 Planning Commission October 17, 2011 Location: 5910 N. Major Drive Applicant: Simon Construction Mr. Richardson presented the staff report. In August, 1990, City Council granted Grace and Truth Gospel Tabernacle a specific use permit to allow a church and related parking on the subject property. Due to growth in church membership, additional parking is needed. The church proposed constructing an additional 25 parking spaces. Mr. Richardson recommended approval subject to the following condition:  The new parking lot shall meet the interior and perimeter landscaping requirements. Seven notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned. Chairman Makin opened the public hearing and asked for the applicant=s comments. Leonardo Zuniga addressed the Commission. Chairman Makin asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Mason made a motion to approve an amended specific use permit to allow an expansion of church parking in an RM-H District at 5910 N. Major Drive as requested in File 2110-P, subject to the following condition:  The new parking lot shall meet the interior and perimeter landscaping requirements. Commissioner Little seconded the motion. Motion to approve carried 7:0. 3) File 2111-P: Request for a specific use permit to allow a convenience store/gas station in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District. Location: 5112 Martin Luther King, Jr. Parkway South Applicant: C-Store GDP, LLC Mr. Richardson presented the staff report. C-Store GDP, LLC proposes 3 Planning Commission October 17, 2011 building a two phase facility that will include a 3,560 sq. ft. convenience store and five two sided pump stations in the first phase. The second phase will include two diesel bays and a driveway that will extend from Vermont to Florida. Mr. Richardson recommended approval subject to the following condition:  The proposed sidewalk will be extended along the southeast corner of the subject property. Fourteen notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned. Slides of the subject property were shown. Chairman Makin opened the public hearing and asked for the applicant=s comments. The applicant was present and addressed the Commission. Chairman Makin asked for comments in favor or in opposition. No comments were made. The public hearing was closed.
