A Joint Public Hearing of the Planning Commission and City Council was held on August 15,
2016 and called to order at 3:22 p.m. with the following members present:

APPROVAL OF MINUTES
Commissioner Makin made a motion to approve the minutes from July 18, 2016 but stated the
date was incorrect for the approval of the July minutes and the date for the approval should
reflect June 20, 2016 instead of July 18, 2016. Commissioner Mason seconded the motion.
Motion to approve minutes with corrections carried 7:0.
REGULAR MEETING
No regular meeting was held.
JOINT PUBLIC HEARINGS
Mayor Ames called the Joint Public Hearing of August 15, 2016 to order and explained
the purpose of the joint hearing process and then turned the meeting over to Chairman
Nejad. Chairman Nejad explained the policies and procedures for the hearing process.
1) File 2268-Z: Consider a request for a Rezoning from R-S (Residential-Single Family
Dwelling District) to GC-MD (General Commercial-Multiple Family Dwelling District)
or a more restrictive district.
Applicant: John Wilson
Location: 1350 W. Lucas Drive
Mr. Boone presented the staff report.
John Wilson is requesting a zone change for the property located at 1350 W. Lucas
Drive. The property to the north and west is zoned R-S (Residential Single Family
Dwelling District) and GC-MD (General Commercial - Multiple Family Dwelling
District) to the east and south. The proposed zone change would allow the property to be
used as the business office for J. Wilson's Restaurant located to the south at 4190 Gladys.
Although further commercial encroachment into the residential area is a consideration,
the minor expansion is located on Lucas, a major arterial and would extend no further
than the northern boundary of the GC-MD property to the east.
Slides of the subject property were shown.
Eighteen (18) notices were mailed to property owners within 200 feet of the subject
property. No responses were received in favor and one response was received in
opposition. The property owners David K. and Bonnie C. Faul stated on the notice that
they opposed because they needed more information about the Specific Use Permit. The
applicant requested a blanket GC-MD.

Discussion followed between Mayor Ames and Mr. Boone.
Chairman Nejad asked if any fencing was required. Mr. Boone stated that if the property
is developed, it is required to have a thirty (30) foot vegetative buffer or a ten (10) foot
buffer with an eight (8) foot privacy fence. A buffer between the subject property and the
adjacent property would be required.
The applicant, John Wilson, 1220 Wilchester Circle, addressed the Commissioners.
Discussion followed. Chairman Nejad opened the public hearing and asked if anyone
wanted to speak for or against the case. David Faul, 8755 Oaks Road, addressed the
Commissioners, discussion followed. Mr. Faul did not speak in favor of or against the
case.
The public hearing was closed.
Commissioner Little made a motion to approve the request for a Rezoning from R-S
(Residential Single Family Dwelling District) to GC-MD-2 (General Commercial-
Multiple Family Dwelling District-2) as requested in File 2268-Z. Commissioner Mason
seconded the motion. Motion to approve carried 7:0.
2) File 2269-Z: Consider a request for a Rezoning from NC (Neighborhood Commercial
District to GC-MD (General Commercial-Multiple Family Dwelling District) or a more
restrictive district.
Applicant: Ronald Smith
Location: 5190 Forsythe Street
Mr. Boone presented the staff report.
Ronald Smith is requesting a zone change for the property located at 5190 Forsythe
Street. Mr. Smith intends to operate a towing service from the property. Staff informed
Mr. Smith that storage will be limited to 30 vehicles in GC-MD (General Commercial -
Multiple Family Dwelling District) zoning. The applicant stated that he is aware the CM
(Commercial - Manufacturing) zoning, located adjacent to his property on the north side,
would allow him more storage by right. However, GC-MD would allow him more
flexibility for future business endeavors if his towing business was not successful.
Although it borders to the east with RS, the property to the west is zoned HI (Heavy
Industrial), and the majority of the properties along Delmar are zoned and used as GC-
MD.
Twenty-six (26) notices were mailed within 200 feet of the subject property. No
responses were received in favor or in opposition.
Slides of the subject property were shown.
Based on the land use and zoning pattern, Staff recommended approval.

The applicant, Mr. Roland Smith had emergency surgery and he was unable to attend
the meeting.
Chairman Nejad opened the public hearing and asked for any comments.
The public hearing was closed.
Commissioner Mason made a motion to approve a request for a Rezoning from NC
(Neighborhood Commercial District) to GC-MD (General Commercial-Multiple Family
Dwelling District) as requested in File 2269-Z. Commissioner Makin seconded the
motion. Motion to approve carried 7:0.
3) File 2270-Z: Consider a request for a Rezoning from GC-MD-2 (General Commercial-
Multiple Family Dwelling District-2) and RM-H (Residential Multiple Family Dwelling
District-Highest Density) to GC-MD (General Commercial-Multiple Family Dwelling
District) or a more restrictive district.
Applicant: Chris Johnsen
Location: 6365 Calder & 145 Junker Road
Mr. Boone presented the staff report.
Chris Johnsen is requesting a zone change for the property located at 6365 Calder and
145 Junker Road. Mr. Johnsen states his company would like to develop the property for
commercial office and retail property. Junker Road is a minor residential street that only
exits to Calder Avenue. Further commercial encroachment to this street will compromise
the residential neighborhoods accessed by this street. Extending the GC-MD-2 property
that faces Calder Avenue further to the south would allow further development of this
property off Calder Avenue, while limiting commercial access to Junker Road.
Planning staff recommends rezoning the northern approximately 300 x ~168.5 feet to
GC-MD-2 (General Commercial - Multiple Family Dwelling District -2). The remainder
of the property should remain RM-H (Residential Multiple Family Dwelling - Highest
Density District), with no GC-MD-2 uses accessing Junker Road now or in the future.
Slides of the subject property were shown.
Twenty-six (26) notices were mailed within 200 feet of the subject property. No
responses were received in favor and four were received in opposition. A petition with
twenty-one signatures opposing the project was also received.
Mr. Little asked if there was room to approve a GC-MD-2 with a non-access easement to
Junker Road in the future. Discussion followed.
The applicant was present. Chris Johnsen, 7550 San Diego addressed the Commissioners.
Mr. Johnsen stated that he would like the Commissioners to extend the boarder of GC-
MD-2. Commissioner Makin asked Mr. Johnsen had he purchased the property and what

were his intentions. He stated yes, and that his family wanted to develop another
Johnsen’s florist and possibly add a small retail center.
Chairman Nejad opened the public hearing and asked for any comments.
Glenn Johnson, 270 Junker Road addressed the Commissioners. Mr. Johnson stated that
he owns the Shell gas station across the street from the subject property. Discussion
followed.
Chairman Nejad opened the public and asked if anyone else would like to speak for or
against the case.
The public hearing was closed.
Commissioner Little made a motion to approve a request for Rezoning the north
approximately 300 x ~168.5 feet to GC-MD-2 (General Commercial - Multiple Family
Dwelling District -2) as requested in File 2270-Z. Commissioner Cook seconded the
motion. Motion to approve carried 7:0.
