June 20, 2016 Commissioner Senigaur made a motion to approve the minutes from July 18, 2016. Commissioner Graves seconded the motion. Motion to approve carried 6:0. REGULAR MEETING 1) Replat-Deer Run Estates, Lots 10,11,17 & 18, Block, 1: A request for a Replat of Lots 10, 11, 17 & 18, Block 1 Queensberry Estates and 23.82 acres out of the James Gerish, Sr. Survey into Deer Run Estates, Jefferson County, Texas. Applicant: Faust Engineering and Surveying, Inc. Location: Approximately 3 miles west of the Beaumont Municipal Airport and the Beaumont city limits along Old Sour Lake Road, within the city’s Planning area of the ETJ (Extraterritorial Jurisdiction). Mr. Boone presented the staff report. Richard Faust, representing Faust Engineering and Surveying, Inc., has requested approval of Replat of Lot 10, 11, 17 and Lot 18, Block 1, out of Queensberry Estates, Section 1 and a 23.83 acre tract out of James Gerish Sr. Survey, Abstract 25, Jefferson County, Texas into Deer Run Estates Lots 1,2,3 and 4, Jefferson County, Texas. The purpose of this replat is to divide the remainder of the said 23.82 acre tract into 3 lots, and combine with 4 lots from Queensberry Estates to provide access. Lot 1, Deer Run Estates will have access via Nato Road. Lot 2, Deer Run Estates, will be combined with Lot 17, Queensberry Estates to allow access to Sandringham. Lot 3, Deer Run Estates will be combined with Lot 10 & 11, Queensberry Estates to allow access to Sandringham. Lot 18, Queensberry Estates, will become Lot 4, Deer Run Estates, having access to Sandringham. Slides were shown of the subject property. Thirty-eight (38) notices were mailed to property owners within 200 feet of the subject property. No responses were received in favor and no responses were received in opposition. The Planning staff recommended approval. Mr. Richard Faust of 2525 Calder, representing Faust Engineering and Surveying, Inc., addressed the board. Discussion followed. The public hearing was opened. No one spoke in favor of or against the case. The public hearing was closed. Commissioner Mason made a motion to approve the Replat of Deer Run Estates, Lots 10, 11, 17, & 18, Block 1 Queensberry Estates and 23.82 acres out of the James Gerish, Sr. as requested. Commissioner Graves seconded the motion. Motion to approve carried 6:0. 2 Planning and Zoning July 18, 2016 2) Replat-Country Oaks: Consider a request for a Replat of Shalom Stone Subdivision into Country Oaks, Beaumont, Jefferson County, Texas Applicant: Soutex Surveyors & Engineers Location: North side of Tram Road at the intersection of FM Highway 364. Mr. Boone presented the staff report. Soutex Surveyors and Engineers, has requested approval of Replat of all of Lots 1-22, Shalom Stone Subdivision, Beaumont, Jefferson County, Texas, into Country Oaks, Beaumont, Jefferson County, Texas. The purpose of this replat is to rename the 11.75 acre Shalom Stone Subdivision to Country Oaks and record covenants and restrictions under the new name. The street, drainage and municipal utilities have been installed and approved by engineering. Slides were shown of the subject property. Ten (10) notices were mailed to property owners within 200 feet of the subject property. No responses were received in favor and no responses were received in opposition. The Planning staff recommended approval. Chairman Nejad stated that he could not read the zoning lines located in front of the property. Mr. Boone stated that there is a zone AE and a zone X shaded boundary that runs through Lots 2, 21, 22 and part of Lot 1. Raymond Rowzee stated on the new map it has been changed to zone X. Anthony Leger of 3737 Doctors Drive, representing Soutex Engineers and Surveyors, addressed the board. Mr. Leger stated they wanted a name change for the subdivision Shalom Stone to Country Oaks. Discussion followed. The public hearing was opened. No other questions or comments were made. The public hearing closed. Commissioner Senigaur made a motion to approve a replat of all of Lots 1-22, Shalom Stone Subdivision as requested. Commissioner Little seconded the motion. Motion to approve carried 6:0. 3) Preliminary Plat-Love’s Subdivision: Consider a request for preliminary plat approval of Love’s subdivision. Applicant: Faust Engineering & Surveying, Inc. Location: Smith Road and IH-10 Mr. Boone presented the staff report. Faust Engineering and Surveying, Inc. have requested preliminary plat approval of Love’s Subdivision. The property is located at the north side of the intersection of IH-10 S and Smith Road in the ETJ of the City of Beaumont. The development is a 30.56 acre, 3 lot, subdivision. All lots will access Smith Road or IH-10 Service Road. 3 Planning and Zoning July 18, 2016 Water and sanitary sewer will be provided by extension of West Jefferson County Water Municipal Water District Services. Slides were shown of the subject property. The item was sent to all interested parties. The Planning staff recommended approval. Richard Faust of 2525 Calder, representing Faust Engineering and Surveying, Inc. addressed the board. Discussion followed. No public hearing was required. Commissioner Little made a motion to approve a request for a preliminary plat of Love’s subdivision. Commissioner Senigaur seconded the motion. Motion to approved carried 6:0. JOINT PUBLIC HEARINGS 1) File 2267-P: Consider a request for a Specific Use Permit request to operate a church on property zoned R-S (Residential-Single Family Dwelling District). Applicant: Gospel Tabernacle of Beaumont Location: 7820 and 7880 Washington Boulevard Mr. Boone presented the staff report. Gospel Tabernacle of Beaumont would like to construct a new church facility on their property at 7820 and 7880 Washington Boulevard. This property along with all of the surrounding property is zoned and developed, as single family residential. A church would be compatible with the area. Utilities are available at this site and parking is adequate for the proposed structure. Services are held Sunday evenings and Tuesday evenings at their current location. Fourteen (14) notices were mailed to property owners within 200 feet of the subject property. One response was received in favor and none in opposition. Slides of the subject property were shown. Staff recommended approval with the following conditions: 1. An 8 foot wood or masonry privacy fence be constructed at the property line to buffer adjacent properties when adjacent lots are developed. 2. If remaining property to the north is sold, the dumpster must be removed from the 10 foot wide landscaped buffer. 4 Planning and Zoning July 18, 2016 3. Provide a sidewalk along Washington Boulevard or obtain a sidewalk waiver. The applicant, Pastor Mike LaBrie of 1225 Glendale, Texas addressed the Commissioners. Discussion followed. Chairman Nejad opened the public hearing and asked if anyone wanted to speak for or against the case. The public hearing was closed.
