Pate Also present: Chris Boone, Director of Planning and Community Development, Raymond Rowzee, Planner I Fran Malvo, Recording Secretary Tyrone Cooper, City Attorney 1 Planning and Zoning June 20, 2016 APPROVAL OF MINUTES Commissioner Messina made a motion to approve the minutes from May 16, 2016. Commissioner Mason seconded the motion. Motion to approve carried 8:0. REGULAR MEETING No regular meeting was held. JOINT PUBLIC HEARINGS 1) File 2265-P: Consider a request for a Specific Use Permit request to operate a boat on trailer manufacturing and repair business on property zoned GC-MD (General Commercial-Multiple Family Dwelling District). Applicant: Royce V. Long Location: 4832 Washington Boulevard Mr. Boone presented the staff report. Royce V. Long has been in operation at 5480 Washington with a Specific Use Permit since March of 2011 and has now entered into a lease for the property located at 4832 Washington Boulevard. Mr. Long states that the property will be used for the construction and repair of trailers and parts sales. Welding of steel and aluminum will be done inside the building. All galvanizing of trailers and parts will be done by AZZ Galvanizing at another location. No use of chemicals that have any odor will be used on the property. The only dust will be from table and circular saws. All grinding of small steel items, cutting of plywood or any other type of noisy operation will be inside the building where plywood walls and insulation have been installed to prevent any disturbance to neighbors. Hours of operation are from 8 a.m. to 5 p.m., Monday through Friday and sometimes on Saturday. The trailers will be parked inside a fenced area. Mr. Long states that his company does not work on anything such as chemical tanks or any large vessel type trailer other than repairing lights on such trailers. Slides of the subject property were shown. Seventeen (17) notices were mailed to property owners within 200 feet of the subject property. No responses were received in favor or in opposition. Staff recommended approval subject to the revised site plan. 2 Planning and Zoning June 20, 2016 The applicant, Royce Long from Vidor, Texas addressed the Commissioners. Discussion followed. Mr. Long stated that they do build small trailers for the boat. Chairman Nejad opened the public hearing and asked if anyone wanted to speak for or against the case. The public hearing was closed. Commissioner Mason made a motion to approve the request for a Specific Use Permit to operate a boat trailer manufacturing and repair business on property zoned GC-MD (General Commercial-Multiple Family Dwelling District) as requested in File 2265-P with the conditions of revising the original site plans. Motion to approve carried 8:0. 2) File 2266-P: Consider a request for a Specific Use Permit to operate a silver recovery business on property zoned LI (Light Industrial District). Applicant: Michael Montoya and Austin Haylock Location: 6650 Westwood Boulevard Mr. Boone presented the staff report. Michael Montoya and Austin Haylock have applied for a Specific Use Permit for the property located at 6650 Westwood Boulevard. The applicant would like to recover silver from x-ray photo solution at this location. Recovery would be performed by a combination of electrolysis and filtration. Purification of the silver is accomplished with a jewelry kiln to melt the silver. When photo solution is saturated with silver chloride to the point that silver extraction is profitable, the solution is a hazardous material. Based on the application, it appears that the City of Beaumont requires that wastewater meets a higher standard than what the applicant has proposed. The City water quality staff has been communicating with the applicant, but has not yet received all the data needed to fully analyze the process used. Slides of the subject property were shown. Fourteen (14) notices were mailed within 200 feet of the subject property. No responses were received in favor or in opposition. Staff recommended approval subject to the following conditions: 1. No processed water is to be discharged into the public system without the approval of the Water Utilities Department and all process water should be contained and disposed of offsite. The applicants were present. Michael Montoya, 3112 Monroe Street, Nederland, Texas and Austin Haylock, 20615 W. Ingham Place, Buckeye, Arizona addressed the Commissioners. Mr. Haylock explained the process to the Commissioners and stated that they are using a third party hazmat business to come and dispose of the solution offsite which is also 3 Planning and Zoning June 20, 2016 licensed and bonded. At least 220 pounds of hazardous waste a month is what is considered in order to remain at a conditionally exempt status and no permit is needed. Blain Dishman with the Water Utilities Department address the Commissioners. Mr. Dishman stated he found no discrepancies with the offsite waste. Discussion followed. Chairman Nejad opened the public hearing and asked for any comments. The public hearing was closed. Commissioner Makin made a motion to approve a Specific Use Permit to operate a silver recovery business on property zoned LI (Light Industrial District) as requested in File 2266-P with the following condition: 1. Commissioner Mason seconded the motion. Motion to approve carried 8:0. 3) File 868-OB: Consider an amendment to the Rules and Regulations of the City of Beaumont Planning and Zoning Commission, Article V, Zoning Hearings, Procedures and Rules, Section 8. Applicant: City of Beaumont Mr. Boone presented the staff report. Staff is proposing an amendment to The Rules and Regulations of the City of Beaumont Planning and Zoning Commission, to clarify when a request for rezoning may be resubmitted. Therefore, City staff recommends the following amendment to Article V, Zoning Hearings, Procedures and Rules, Section 8 to read as follows: All applications for amendment to the Zoning Ordinance shall be scheduled for the next reasonable hearing date available by the Planning Division staff. However, if a any rezoning request has been considered on the same parcel of land during the past twelve calendar months, said request will not be scheduled until the end of the twelve (12) month period as follows: (1) Upon request of our referral back from the City Council; (2) On written request by the applicant with pertinent facts which the City Planning Commission deemed sufficient to warrant a new hearing, such request shall not be set for public hearing unless approved by a majority vote of the Commission. If a hearing is granted by the Commission upon request 4 Planning and Zoning June 20, 2016 of the applicant, the procedure will be the same as that given original application for a zone change. Chairman Nejad opened the public hearing and asked for any comments. The public hearing was closed. Commissioner Mason made a motion to approve an amendment to the Rules and Regulations of the City of Beaumont Planning and Zoning Commission, Article V, Zoning Hearings, Procedures and Rules, Section 8 as requested in File 868-OB. Commissioner Messina seconded the motion. Motion to approve carried 8:0. OTHER BUSINESS None THERE BEING NO OTHER BUSINESS, THE MEETING WAS ADJOURNED AT 3:26 P.M. 5
