A Regular Meeting and Joint Public Hearings of the Planning Commission and City Council was
held on May 16, 2016 and called to order at 3:15 p.m. with the following members present:

APPROVAL OF MINUTES
Commissioner Craig made a motion to approve the minutes from March 21, 2016.
Commissioner Spikes seconded the motion. Motion to approve carried 8:0. *Commissioner
Graves made comments regarding the minutes, stated that Councilmember Samuel was shown
absent and present, on Pg. 4 Commissioner Graves pointed out that she rescinded a motion,
wanted to know if it needed to be shown in minutes, City Attorney Cooper, stated that the
rescind could be shown in the minutes as presented. *
REGULAR MEETING
1) Replat – The Meadowlands, Block 4: Consider a request for approval of a Replat of The
Meadowlands, Block 4 and a 0.319 acre tract of land into Lot 28, Block 4, The
Meadowlands, Beaumont, Jefferson County, Texas.
Applicant: Fitz & Shipman, Inc.
Location: 6535 Durango Drive
Mr. Boone presented the staff report.
The purpose of the replat is to create a new lot.
Fitz & Shipman, Inc. have requested approval of a Replat of Block 4, The Meadowlands
and 0.319 acre tract of land into Lot 28, Block 4, The Meadowlands.
The property is located at 6535 Durango Drive.
The proposed lot does meet the required minimum lot size.
Slides of the subject property were shown.
Twenty two (22) notices were mailed to property owners within 200 feet of the subject
property. No responses were received in favor and no responses were received in
opposition.
The Planning staff recommended approval.
Chairman Nejad asked if anyone would like to speak for or against the case.
Mitch Brakin with Fitz & Shipman, spoke regarding this item and answered any
questions.

Commissioner Craig made a motion to approve the request for a Replat of The Meadowlands,
Block 4 and a 0.319 acre tract of land into Lot 28, Block 4, The Meadowlands, Beaumont,
Jefferson County, Texas. Commissioner Senigaur seconded the motion. Motion to approve
carried 8:0.
JOINT PUBLIC HEARINGS
1) File 2260-Z: Consider a request to rezone a 6.00 acre tract of land from R-S – l
(Residential - Single Family District) to GC-MD (General Commercial –
Multiple Family Dwelling District) or a more restrictive zoning district.
Applicant: Mark Whiteley & Associates, Inc.
Location: Eastex Freeway, approximately 500 feet northwest of Caswell Road
Mr. Boone presented the staff report.
Mark W. Whiteley and Associates, Inc., on behalf of Gospel Center Church, is requesting
a zone change for approximately 5.14 acres to the west of 7505 Eastex Freeway.
Property to the east and west is zoned GC-MD (General Commercial – Multiple Family
Dwelling District). While staff agrees that the most appropriate zoning of the property
would be commercial, GC-MD-2 (General Commercial – Multiple Family Dwelling
District – 2) would be more appropriate, allowing for additional protection of the
residential properties to the south.
Slides of the subject property were shown.
Seventeen (17) notices were mailed to property owners within 200 feet of the subject
property. Two (2) responses were received in favor and two (2) in opposition. The
oppositions expressed concerns for GC-MD and the effects it might have on their
properties.
Chairman Nejad opened the public hearing and asked if anyone wanted to speak for or
against the case.
Tom Rowe, with Mark Whiteley & Associates, Inc., addressed Commissioners on
behalf of Gospel Center Church.
The public hearing was closed.
Commissioner Craig made a motion to approve the request to rezone a 6.00 acre tract of
land from R-S (Residential – Single Family District) to GC-MD (General Commercial –
Multiple Family Dwelling District) or a more restrictive zoning district. Commissioner
Williams-Mason seconded the motion. Motion to approve carried 8:0.

2) File 2261-Z: Consider a request to rezone a 1.00 acre tract of land from R-S
(Residential - Single Family Dwelling District) to GC-MD-2 (General
Commercial - Multiple Family Dwelling District - 2).
Applicant: Hani Tohme of Golden Triangle Consulting Engineers
Location: The south side of Washington Blvd. between Blossom Drive & Municipal
Drive
Mr. Boone presented the staff report.
In January of this year, Mr. Hani Tohme submitted a request to rezone this property from
R-S (Residential – Single Family Dwelling District) to GC-MD (General Commercial –
Multiple Family Dwelling District). Following discussion as well as voiced opposition,
the Planning Commission asked the applicant to consider GC-MD-2 as an alternative.
Mr. Johns, the owner of the property, said that he was not interested, and the Planning
Commission recommended denial of the request. Mr. Tohme has now submitted a
request to rezone the same piece of property from R-S to GC-MD-2. Approval of GC-
MD-2 would require that the applicant gain approval of a Specific Use Permit before he
could develop the property.

This item was sent to all interested parties.
Eight (8) notices were mailed to property owners within 200 feet of the subject property.
One (1) response in favor and three (3) in opposition were received. The three (3) in
opposition would like the property to remain zoned RS.
Chairman Nejad opened the public hearing and asked for any comments.
Hani Tohme, with Golden Triangle Consulting Engineers, spoke regarding this item
and answered any questions.
Kent Johns, owner of the property spoke regarding this item and answered any
questions.
The public hearing was closed.
Commissioner Senigaur made a motion to approve a request to rezone a 1.00 acre tract of
land from R-S (Residential – Single Family Dwelling District) to GC-MD-2 (General
Commercial – Multiple Family Dwelling District – 2). Commissioner Cook seconded the
motion. Commissioners Colbert, Graves and Craig opposed. Motion to approve carried

3. File 2262-Z: Consider a request to rezone a 1.456 acre tract from RM-H (Residential
-Multiple Family Dwelling – Highest Density District) to GC-MD
(General Commercial - Multiple Family Dwelling District).
Applicant: Parkdale Church
Location: 4490 Crow Road
Mr. Boone presented the staff report.
Planning staff recommends rezoning to GC-MD-2 (General Commercial – Multiple
Family Dwelling District – 2)
Parkdale Church plans to sell their property located at 4490 Crow Road. The property is
currently zoned RM-H (Residential Multiple Family Dwelling – Highest Density
District), but all other properties at the intersection of Crow Road and Odom Road and
Dowlen Road are zoned GC-MD (General Commercial – Multiple Family Dwelling
District). Although the Planning staff agrees that the RM-H zoning is inconsistent with
other properties at this intersection, staff recommends rezoning to GC-MD-2 (General
Commercial – Multiple Family Dwelling District – 2) to protect the residential properties
immediately adjacent to the subject property. Potential buyers would be required to
submit Specific Use Permits for any use other than a church.

Seven (7) notices were mailed to property owners within 200 feet of the subject property.
One (1) response was received in favor and two (2) in opposition. Of the two (2) in
opposition, one (1) was mistaken thinking the case was for their own property, the other
called soon after mailing the response to retract the disapproval, as they had discussed
plans with the owner.
Chairman Nejad opened the public hearing and asked for any comments.
Sam Parigi, spoke regarding this item and answered any questions.
The public hearing was closed.
Commissioner Craig made a motion to approve a request to rezone a 1.456 acre tract of
land from RM-H (Residential Multiple Family Dwelling – Highest Density District) to
GC-MD-2 (General Commercial – Multiple Family Dwelling District – 2).
Commissioner Williams-Mason seconded the motion. Motion to approve carried 8:0.
4. File 2263-P: Consider a request for a revised Specific Use Permit to allow the Expansion
of an existing self-storage facility.
Applicant: Greg Allen
Location: 1655 South Major Drive

Mr. Boone presented the staff report.
Staff recommended approval of the request with the following conditions:
1. All requirements set forth by City Fire Department be met.
2. Installation of a sidewalk along Major Drive.
Greg Allen requested and received a Specific Use Permit to open a self-storage facility at
1655 S. Major Drive in July of 2003. This current request is to allow two (2) additional
buildings on the property. These new buildings would expand the property’s storage
capacity. The new structures are located at Major Drive and should not further disturb
neighboring properties to the east. There will be no changes to the hours of operation, or
the manner in which business is conducted at the site.

Robert Fisher with Uncle Bob’s, spoke regarding this item and answered any
questions.

Commissioner Williams-Mason made a motion to approve a request for a revised
Specific Use Permit to allow the expansion of an existing self-storage facility, with the
following conditions: 1) All requirements set forth by the City Fire Department be met
and; 2) Installation of a sidewalk along Major Drive. Commissioner Cook seconded the
motion. Motion to approve carried 8:0.
5. File 2264-P: Consider a request for a Specific Use Permit to allow a Marina and
Recreational Vehicle Park in a GC-MD (General Commercial - Multiple
Family Dwelling District).
Applicant: USA Self Storage Inc.
Location: 560 Marina Drive
Mr. Boone presented the staff report.
Staff recommended approval of the request with the following conditions:
1. All floodplain and floodway requirements be met.

2. All requirements set forth by the City Fire Department be met.
3. The site plan meets all Recreational Vehicle design requirements set forth in Section
24.06.008 of the City of Beaumont Ordinance.
USA Self Storage, Inc. is requesting a Specific Use Permit to allow a recreational vehicle
park and marina in a GC-MD (General Commercial – Multiple Family Dwelling
District).
The 30.18 acre tract of land is located at the edge of the Neches River. This property has
been operated as the Beaumont Marina for many years. There will be approximately 149
RV parking spaces/rental cabins, a clubhouse, pavilion, laundry facilities and a
swimming pool on site.
The property is currently used as a public marina for boat launches, for wet and dry boat
storage and for operation of the Beaumont Yacht Club. USA intends to continue to
enhance and improve the marina operations.

Lance Fox, 3545 Calder, spoke regarding this item and answered any questions.
The public hearing was closed.
Commissioner Senigaur made a motion to approve a request for a Specific Use Permit to
allow a Marina and Recreational Vehicle Park in a GC-MD (General Commercial –
Multiple Family Dwelling District) with the following conditions; 1) All floodplain and
floodway requirements be met; 2) All requirements set forth by City Fire Department be
met; 3) The site plan meet all Recreational Vehicle design requirements set forth in
Section 24.06.008 of the City of Beaumont Ordinance. Commissioner Craig seconded
the motion. Motion to approve carried 8:0.
6. File 867-OB: Consider a request for annexation of approximately 77.737 Acres of land.
Applicant: City of Beaumont Planning Division
Location: The southwest corner of Folsom Drive @ Major Drive.
Mr. Boone presented the staff report.
The City has identified a 77.737 acre area, for possible annexation into the City of
Beaumont. The area is located at the southwest corner of Folsom Drive and Major Drive.

This area is divided into five (5) parcels and is served by city water and sewer services
from Major Drive. This portion of Major Drive has experienced new development,
including a church, an apartment complex and a restaurant. Being outside the city limits,
fire, emergency and police response to these properties is currently limited. Because of
these facts, staff recommended annexing this area. In addition to this hearing, there will
be two additional hearings before the City Council prior to adoption of the ordinance for
annexation. The Commissioners were given a copy of the “Annexation Service Plan”
outlining the municipal services to this area as it is incorporated into the City of
Beaumont.

approximately 77.737 Acres of land. Commissioner Cook seconded the motion. Motion
to approve carried 8:0.
