Councilwoman Gethrel Williams-Wright Councilwoman Robin Mouton Councilmembers absent: Councilman Audwin Samuel Also present: Chris Boone, Director of Planning and Community Development; Adina Ward, Planner II; Raymond Rowzee, Planner I, Fran Malvo, Recording Secretary; Quentin Price, Assistant City Attorney 1 Planning and Zoning April 18, 2016 APPROVAL OF MINUTES Commissioner Makin made a motion to approve the minutes from March 21, 2016. Commissioner Mason seconded the motion. Motion to approve carried 7:0. *Commissioner Little stepped out of the meeting before it began and he returned before the Regular Meeting started. * REGULAR MEETING 1) Replat of a portion of Block 14, Columbus Cartwright Subdivision No. 1: Consider a request for approval of a Replat of a portion of Block 14, Columbus Cartwright Subdivision No. 1, Beaumont, Jefferson County, Texas Applicant: Areceneaux, Wilson & Cole Location: 1255 IH-10 South Mr. Boone presented the staff report. Jimmy Verrett, representing Arceneaux, Wilson & Cole has requested approval of a Replat of a portion of Block 14, Columbus Cartwright Subdivision No. 1. The property is located at 1255 IH-10 South. However, the proposed Tract B does not meet the minimum lot size of 10,000 square feet as required by the subdivision regulations and zoning ordinance for a lot in an L-I (Light Industrial) District. The applicant is requesting waivers for: The required minimum lot size of 100’ X 100’, the required building setbacks, the required parking, and the required landscaping and buffers. Slides of the subject property were shown. Four (4) notices were mailed to property owners within 200 feet of the subject property. No responses were received in favor and no responses were received in opposition. The Planning staff recommends denial. th Michael Lindsay of 710 N.11 Street is an attorney for Lindsay and Morgan. Mr. Lindsay, representing Vaughn Ayers, who is the owner of the property, addressed the Commissioners. Mr. Lindsay stated that he wanted to put small business to be constructed on the premises and utilities are readily available to the property. Mr. Lindsay stated that he felt that the small piece of property could be developed as a viable commercial location. Vice Chairman Craig asked if anyone would like to speak for or against the case. The public hearing was closed. 2 Planning and Zoning April 18, 2016 Commissioner Mason made a motion to deny the request for a Replat of a portion of Block 14, Columbus Cartwright Subdivision No. 1. Commissioner Colbert seconded the motion. Motion to deny carried 6:1. Commissioner Cook opposed the denial. JOINT PUBLIC HEARINGS 1) File 2259-P: Consider a request for a Revised Specific Use Permit to waive the perimeter landscape buffer and screening requirements for the south and east property lines. Applicant: Toni J. Prados Location: 4570 Highland Mr. Boone presented the staff report. On February 2, 2016, City Council awarded Toni J. Prados, owner of Area Impressions, a Specific Use Permit to allow a retail T-shirt and merchandise print shop at 4570 Highland Avenue, with the following conditions: 1. Parking and driveways must meet city standards. 2. Parallel space at front of building must be next to the building, allowing traffic to flow around it and curb cut on Highland must remain to allow exit of traffic. 3. Paving must extend past the handicapped access aisle and handicapped space must have proper signage. 4. An eight (8) foot privacy fence and ten (10) foot landscape buffer must be installed and maintained along the east and south property lines. 5. An automatic irrigation system must be installed, sufficient to provide complete coverage of all required landscaping. Ms. Prados is now asking for a waiver to the perimeter landscape buffer and screening requirements for the south and east property lines. Due to the RS (Residential Single Family Dwelling District) zoning to the east, staff is recommending protection for the residential neighborhood with the installation of an eight (8) foot privacy fence. Slides of the subject property were shown. Twelve (12) notices were mailed to property owners within 200 feet of the subject property. No responses were received in favor or in opposition. The Planning staff recommended approval with the following conditions: 1. An eight (8) foot privacy fence be installed along the east property line. 2. Parking and driveways must meet city standards. 3. Parallel space at front of building must be next to the building, allowing traffic to flow around it and curb cut on Highland must remain to allow exit of traffic. 4. Paving must extend past the handicapped access aisle and handicapped space must have proper signage. 3 Planning and Zoning April 18, 2016 Toni J. Prados of 1090 Avenue H addressed the Commissioners. Ms. Prados passed out pictures of the property to the Commissioners. Discussion followed. Commissioner Makin asked since one of the conditions is to install an eight (8) foot privacy fence, would she be willing to do that. Ms. Prados replied yes. Discussion followed. Commissioner Graves asked is there much traffic at the place of business and Ms. Prados replied not much. Discussion followed. Councilwomen Wright and Mouton stated that they visited the property and the vegetation camouflages everything and in order to install a fence, Ms. Prados would have to dig up the vegetation. Vice-Chairman Craig opened the public hearing and asked if anyone wanted to speak for or against the case. The public hearing was closed. Commissioner Graves asked how the motion would read if the property was developed in the future in regards to installing a fence. Mr. Boone addressed Commissioner Graves. He stated that the first four conditions would be recommended and that the Commissioners would modify condition one to read 8 foot privacy fence should be installed along the east property line if and when the adjacent property is ever developed residential. Commissioner Little asked could condition one be waived due to the landscaping. Commissioner Graves rescinded her motion. Commissioner Little made a motion to approve a request for a Revised Specific Use Permit to waive the perimeter landscape buffer and screening requirements for the south and east property lines. Commissioner Makin seconded the motion. Motion to approve carried 8:0. 2) File 866-OB: Consider a request to abandon the Muella Creek cul-de-sac, Beaumont, Jefferson County, Texas. Applicant: Rippeon Properties, LTD Location: Cul-de-sac at the west end of Muella Creek Drive Mr. Boone presented the staff report. Rippeon Properties, LTD, is preparing to extend Muella Creek Drive to the west. The preliminary plat for Old Dowlen Business Park Phase 2 was approved in July of 2015. Water, sanitary sewer and drainage pipes are all located within the area to be abandoned, but will be within the new 60' right-of-way as the street is extended. The Planning staff recommends approval of the request to abandon the portion of right- of-way outside of the street right-of-way (60 feet), but within the balance of right-of-way within the public cul-de-sac. Slides of the subject property were shown. This item was sent to all interested parties. 4 Planning and Zoning April 18, 2016 Vice-Chairman Craig opened the public hearing and asked for any comments. The public hearing closed. Commissioner Mason made a motion to approve a request to abandon the Muella Creek cul-de-sac as requested in File 866-OB. Commissioner Cook seconded the motion. Motion to approve carried 8:0. OTHER BUSINESS 1. Possible changes to the Sign Ordinance Mr. Boone stated that the Supreme Court made a decision last summer to make the wording on signage content neutral. The case is Reed, et al vs. Town of Gilbert, Arizona. Mr. Boone stated that there are exceptions. The number, size and height can be regulated but not the content. There are certain exceptions for real estate signs, political signs, construction, warning and directional signs. Substantial changes will need to be made.
